Qurbani is Waajib (on a Sahib-e-nisaab) irrespective if a person is performing hajj or not

Kindly give evidence from quran about farziyat of qurbani on other than hujjaj on 10th zil hajj.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

You enquire about Farziyyat of qurbani from the Quraan. At the outset, we wish to point out that the order of qurbani during Eidul-Adha is not explicitly mentioned in the Quraan. However, it is referred to in the Quraan. Secondly, the order of qurbani during Eidul-Adha is not Fardh. It is Waajib. There are much academic discussions on the definition of Fardh and Waajib which is beyond the understanding of a layman. Hereunder are the relevant sources of the obligation of qurbani. 

عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ قَالَ ‏ “‏ مَنْ كَانَ لَهُ سَعَةٌ وَلَمْ يُضَحِّ فَلاَ يَقْرَبَنَّ مُصَلاَّنَا ‏”‏ ‏.‏ عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّه ـ صلى الله عليه وسلم ـ قَالَ ‏ “‏ مَنْ كَانَ لَهُ سَعَةٌ وَلَمْ يُضَحِّ فَلاَ يَقْرَبَنَّ مُصَلاَّنَا ‏”‏ ‏.‏ (Hadith 3242- Sunan ibn majah)

Translation: “Whoever can afford it, but does not offer a sacrifice, let him not come near our prayer place.”

قَالَ قَالَ أَصْحَابُ رَسُولِ اللَّهِ ـ صلى الله عليه وسلم ـ يَا رَسُولَ اللَّهِ مَا هَذِهِ الأَضَاحِيُّ قَالَ ‏”‏ سُنَّةُ أَبِيكُمْ إِبْرَاهِيمَ ‏”‏ ‏.‏ قَالُوا فَمَا لَنَا فِيهَا يَا رَسُولَ اللَّهِ قَالَ ‏”‏ بِكُلِّ شَعَرَةٍ حَسَنَةٌ ‏”‏ ‏.‏ قَالُوا فَالصُّوفُ يَا رَسُولَ اللَّهِ قَالَ ‏”‏ بِكُلِّ شَعَرَةٍ مِنَ الصُّوفِ حَسَنَةٌ ‏”‏ ‏.‏  (Sunnan ibn majah- Hadith 3247)

Translation: “The Companions of the Messenger of Allah said: ‘O Messenger of Allah, what are these sacrifices?’ He said: ‘The Sunnah of your father Ibrahim.’ They said: ‘What is there for us in them, O Messenger of Allah?’ He said: ‘For every hair, one merit.’ They said: ‘What about wool, O Messenger of Allah?’ He said: ‘For every hair of wool, one merit.’”

عَنْ عَائِشَةَ، قَالَتْ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم‏ “‏ الْفِطْرُ يَوْمَ يُفْطِرُ النَّاسُ وَالأَضْحَى يَوْمَ يُضَحِّي النَّاسُ ‏”‏ )Jami` at-Tirmidhi 802(

Translation: The Messenger of Allah said: “Al-Fitr is the day that the people break the fast, and Al-Adha is the day that the people sacrifice.”

{لَنْ يَنَالَ اللَّهَ لُحُومُهَا وَلَا دِمَاؤُهَا وَلَكِنْ يَنَالُهُ التَّقْوَى مِنْكُمْ} [الحج: 37]

Translation: It is neither their flesh nor their blood that reaches Allah, but it is your Taqwa that reaches Him…
