Can my parents give money to my eldest brother in their lifetime?

Assalam O Alaikum Wa Rahmatullah Wa Barakatuhu

My parents are having 3 sons and 2 daughters. The eldest brother started handsome earning from 2006. My eldest brother salary was utilized by my parents for expenses of younger brother and sisters. A rough total of eldest brother money utilised for education of brothers and sisters,daily needs,marriages and Haj of both parents that comes out to be nearly Rs 220,000 (Twenty two lakhs). 

Now Alhamdulillah all sisters are married (last one in 2015) and happily living ,younger brother (23 years) is in job Masha Allah.


After retirement parents have got cash money from government(deposited in bank). Parents have enough land property worth of few crores.


The question is is it correct on parts of my parents to give money (twenty two lakhs) to my eldest brother in their lifetime.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If your parents took the 22 lakhs as a loan from their eldest son, then they will have to repay the loaned amount. If they did not take 22 lakhs as a loan and your eldest brother offered the money from his side, then your parents do not have to repay the money to him.

According to Shariah, parents should maintain equality with all their children. [1]

However, if there is a valid reason to give preference to one child over the others, in that situation preference could be given to that child.

In the enquired situation, your parents’ consideration of reimbursing the eldest brother for his contribution is valid. It is not regarded as an injustice.

2587 – حدثنا حامد بن عمر، حدثنا أبو عوانة، عن حصين، عن عامر، قال: سمعت النعمان بن بشير رضي الله عنهما، وهو على المنبر يقول: أعطاني أبي عطية، فقالت عمرة بنت رواحة: لا أرضى حتى تشهد رسول الله صلى الله عليه وسلم، فأتى رسول الله صلى الله عليه وسلم، فقال: إني أعطيت ابني من عمرة بنت رواحة عطية، فأمرتني أن أشهدك يا رسول الله، قال: «أعطيت سائر ولدك مثل هذا؟»، قال: لا، قال: «فاتقوا الله واعدلوا بين أولادكم»، قال: فرجع فرد عطيته

باب الهبة للولد، وإذا أعطى بعض ولده شيئا لم يجز، حتى يعدل بينهم ويعطي الآخرين مثله، ولا يشهد عليه وقال النبي صلى الله عليه وسلم: «اعدلوا بين أولادكم في العطية»

3686 – أَخْبَرَنَا مُحَمَّدُ بْنُ حَاتِمٍ، قَالَ: أَنْبَأَنَا حِبَّانُ، قَالَ: أَنْبَأَنَا عَبْدُ اللَّهِ، عَنْ فِطْرٍ، عَنْ مُسْلِمِ بْنِ صُبَيْحٍ، قَالَ: سَمِعْتُ النُّعْمَانَ، يَقُولُ وَهُوَ يَخْطُبُ: انْطَلَقَ بِي أَبِي إِلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يُشْهِدُهُ عَلَى عَطِيَّةٍ أَعْطَانِيهَا، فَقَالَ: «هَلْ لَكَ بَنُونَ سِوَاهُ؟» قَالَ: نَعَمْ، قَالَ: «سَوِّ بَيْنَهُمْ»
