Digital Pictures

Answered as per Hanafi Fiqh by Askimam.org

Mufti Sahib me and my family donot take Digital Pictures with cell phones and camera of animate objects (people, animals, cartoons with eyes etc.) as we know that it is haram.

We told this to our relatives and they stopped taking pictures too, but now the problem is that we see young Ulema and Deeni people specially in Canada/US taking and uploading digital pictures.

Even online Madressahs of Hanafi Deoband background are uploading Vidoes of lectures and also Pictures of their ustaads along with course descriptions.

Now my relative have again started taking pictures and sometimes they take picture of my kid because they say that deeni people also take pictures. Before I used to stop them by saying its wrong and please do not take pictures of me or my kid. Now I cannot stop them and they donot listen and ask me to bring a FATWA.

This has left me extremely confused. Am I wrong or is this new modern deeni concept wrong?

I cannot find an answer anywhere. I want to follow the authentic fatwa that is majority and solid opinion and which is not based on excuse or chance etc.

Please provide me with the correct Fatwa that I can also show to my relatives.

Is it correct that I stop my relatives to take pictures of me and my kid? They donot take in front of me because they are afraid but at my back they do take pictures of my kid. When I find this I get angry.

Before I used to complain but now they argue for Fatwa. Is this anger or stopping them is correct? Or I should not care if they are taking pictures in front of me or behind me?

which website is original authentic website? Askimam.org or Askimam.com?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātu

In recent times, digital pictures being tasweer or not has been an issue of intense discussion and debate among reliable Ulama and Muftis. While some believe that the capturing of electronic images is not tasweer, others believe it to be tasweer and prohibited.

Irrespective of the differences of opinions and academic substantiations, all are unanimous that to regard digital pictures as tasweer is a more cautious view. Accordingly, our advice is you regard digital pictures as tasweer and abstain from it to the best of your ability without getting into confrontation with anyone practicing on the view of other reliable Ulama.
