Adding a Clause or a Condition When Gifting an Item

Question:

Whilst alive if I give all my wealth and property in equal shares to my children, can I add a clause, that allows me to collect income or rent on the assets I gave away until I die. Is that Shari’ah-compliant?

In the name of Allāh, Most Gracious, Most Merciful.

Answer:

Once wealth or property is gifted to someone, complete ownership is transferred to them. In the described case, such conditions or clauses are impermissible. (See: Rad Al-Muḥtār, Vol 5, Page 241, Dār Al-Fikr)1
