Question

If a person masturbate and ejaculate while he is fasting in ramadan and afterwards, during that very same day, he had sexual intercourse, is kaffarah wajib on him knowing that masturbation does not necessitate kaffarah but sex does?
Secondly, if a couple intentionally does not fast in Ramadan to have sex during that day, will there be any kaffarah? Or they will only have to make up for that day?


Answer

It is a major sin to intentionally break one’s fast or to abstain from fasting without a valid reason such as sickness or travel.

In response to your question, after masturbating your fast will have broken. Therefore, when you had sexual intercourse later that day you would not have been in a fasting state, hence the sexual intercourse will not result in a penalty (kaffarah) becoming obligatory.

If a person intentionally does not fast then the penalty will not apply to them, however, it is a major sin to not fast without excuse and thus one must repent for not fasting.

In both cases the fast for the day will have to be made up but a penalty will not be obligatory.
