The status of Polyandry in Islam

Answered as per Hanafi Fiqh by TheMufti.com

Q. A woman is in Nikah with one man whilst she is also in ‘Nikah’ with another man. She is also causing many problems for the other man’s first wife. Can you please advise which man is Halaal to the woman?

A. Polyandry (a woman having more than one husband) is not permissible in Islam. A married woman cannot marry another man unless the first husband divorces her or he passes away.

Thus, in the enquired case, if the woman’s first husband did not divorce her or pass way, then the woman’s second ‘marriage’ is not valid.
