Will throwing up bile during pregnancy break fast?

In the name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa rahmatullāhi wa-barakātuhu.

Firstly, here are a few required definitions:

Morning sickness: This refers to nausea and vomiting during pregnancy (NVP).

Phlegm: This refers to excess mucus produced by the respiratory system, particularly that which is expelled through coughing.

Vomiting, or throwing up: This is a forceful discharge of stomach contents through the mouth and sometimes through the nose.

Bile: This is a digestive juice that is secreted by the liver and stored in the gallbladder. Bile travels to the small intestine and helps the body to digest fats from foods.

Generally, after bile has travelled to the small intestine, it does not enter the stomach. However, in some cases it does flow back to the stomach which can cause a bile reflux; vomiting bile. It is common to throw up bile on an empty stomach. It is very common for pregnant women to throw up bile, because frequent bouts of vomiting usually empty their stomach.

Throwing up bile, is not regarded as phlegm in Fiqh. Throwing up bile comes under the general rulings of vomiting.

Accordingly, vomiting bile intentionally or unintentionally, less than a mouthful, will not break the fast (a mouthful is that which cannot be kept in the mouth but with difficulty).

Only vomiting a mouthful of bile intentionally by forcing oneself, or intentionally swallowing the bile will break the fast.[1]

الصائم إذا ذرعه القيء لا يفسد صومه، فإن عاد ِشيء إلى جوفه فهذا على وجهين: إما إن كان القيء ملء الفم [أو أقل من ملء الفم، فإن كان ملء الفم]، فإن عاد بإعادته يفسد صومه بالإجماع، وإن عاد لا بإعادته، قال أبو يوسف: لا يفسد صومه، وقال محمد يفسد… وإن كان القيء أقل من ملء الفم، فعاد شيء منه لا بإعادته، لا يفد صومه بالاتفاق وإن أعاده على قول أبي يوسف: لا يفسد صومه، وعلى قول محمد، يفسد صومه.

وأما إذا تقيء، فإن كان ملء الفم، يفسد صومه بالاتفاق عاد شيء منه إلى جوفه أو لم يعد، وإن كان أقل من ملء الفم، فعلى قول أبي يوسف لا يفسد صومه، عاد شيء إلى جوفه أو أعاده… وعلى قول محمد: يفسد صومه، عاد شيء إلى جوفه أو أعاده أو لم يعد أصلا-

فإن ذرعه القيء لم يفطر لقوله صلى الله عليه وسلم من قاء فلا قضاء عليه ومن استقاء عامدا فعليه القضاء ويستوي فيه ملء الفم وما دونه، فلو عاد وكان ملء الفم فسد عند أبي يوسف لأنه خارج حتى انتقض به الطهارة وقد دخل، وعند محمد لا يفسد لأنه لم توجد صورة الفطر وهو الابتلاع، وكذا معناه لأنه لا يتغذى به عادة، وإن أعاد فسد بالإجماع لوجود الإدخال بعد الخروج فيتحقق صورة الفطر، وإن كان أقل من ملء الفم فعاد لم يفسد صومه لأنه غير خارج ولا صنع له في الإدخال وإن أعاد فكذلك عند أبي يوسف لعدم الخروج، وعند محمد يفسد صومه لوجود الصنع منه في الإدخال فإن استقاء عمدا ملء فيه فعليه القضاء لما روينا-

(أو تقيء ملء فيه) أما القضاء فلما رواه السنن الأربعة من حديث أبي هريرة قال: قال رسول الله صلى الله عليه وسلم: ((من ذرعه القيء- أي سبقه وغلبه- وهو صائم فليس عليه القضاء، ومن استقاء عمدا فليقض)) وقال الدار قطني: رواته كلهم ثقاة… قيد (بملء الفم) لأنه لو تقيء دونه لا يقضي عند أبي يوسف لعدم الخروج حكما، ويقضي عند محمد، وهو الظاهر لأطلاق الحديث السابق، (لا إن غلبه) أي لا يقضي إن غلب القيء ولو أنه ملء الفم-

روزہ کے حالت اگر خودبخود قے ہو جائے تو اس سے روزہ نہیں ٹوٹا، چاہے منہ بھر ہو یا اس سے کم، اور اگر جان بوجھ کر روزہ یاد ہونے کی حالت میں مثلاً انگلی ڈال کر قے کی تو منہ بھر کر قے کرنے کی صورت میں بالاتفاق روزہ ٹوٹ جائے گا، اور اگر منہ بھر سے کم ہے تو اس بارے میں اختلاف ہے، حضرت امام محمد سے ظاہر الروایۃ میں مروی یہ ہے کے روزہ ٹوٹ جائے گا، جب کہ امام ابو یوسف کا قول یہ ہے کہ روزہ نہیں ٹوٹے گا، بعض فقہا نے ابو یوسف کے قول کو ترجیح دی ہے، لیکن امام محمد کے قول میں زیادہ احتیاط ہے۔

جان بوجھ کر منہ بھر کر قے کی جائے تو اس سے روزہ ٹوٹ جاتا ہے، خودبخود ہونے والی قے سے روزہ فاسد نہیں ہوتا ۔
