Does using Taweez remove a person from the fold of Islam?

Answered as per Hanafi Fiqh by Askimam.org

My question is regarding marriage, divorce and Talismans (Taweedh/Taweez).

My friend and I recently learnt that wearing and using Talismans (Taweedh/Taweez) is a form of shirk. She used to be married to her ex-husband for 3 years. As their marriage was going through a tough time, their family members gave them some talismans, which they thought might help them with their marriage problems. Out of forgetfulness, they never wore these Talismans, but still kept them in a drawer in their house. 1-2 years after this, they both filed for divorce.

My friend recently started going to a mosque for classes. Her teacher taught her that using a Talisman makes you leave the fold and boundaries of Islam and Iman, which means you have to take the Shahadah again. This broke her heart and made her wonder that when she was married, and she and her husband took the Talismans, did they really leave the fold of Islam and Iman? Does this mean their Nikkah became nullified at that time, and that their marriage was then counted as Zina?

My friend is really worried about this. If you require further clarification, please feel free to let me know.

JazakAllah Khair for your effort and help.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible to use taweedh on condition it contains verses of the Quran, Duaa and wazeefah and it does not contain any words of kufr and shirk. The use of taweedh is proven from the following:

1.) Abdullah bin Amr narrates that Nabi Sallallahu Alayhi wa Sallam said:

“When one of you becomes frightened during sleep, then let him say: ‘I seek refuge in Allah’s Perfect Words from His anger, His punishment, and the evil of His creatures, from the whisperings of the Shayatin, and that they should come (A`ūdhu bikalimātillāhit-tāmmati min ghaḍabihī wa `iqābihī wa sharri `ibādih, wa min hamazātish-shayāṭīni wa an yaḥḍurūn).’ For verily, they shall not harm him.” He said: “So `Abdullah bin `Amr used to teach it to those of his children who attained maturity, and those of them who did not, he would write it on a sheet and then hang it around his neck.[1]

حدثنا أبو بكر قال: حدثنا يحيى بن آدم، عن أبان بن ثعلب، عن يونس بن خباب، قال: سألت أبا جعفر عن التعويذ يعلق على الصبيان فرخص فيه

2.) Yunus bin Khabaab says: “I asked Abu Ja’far regarding taweedh (amulets) which are hanged (around the necks) of children, and he permitted it.[2]

– حدثنا أبو بكر قال: حدثنا وكيع، عن إسرائيل، عن ثوير، قال: «كان مجاهد يكتب للناس التعويذ فيعلقه عليهم»

3.) Mujahid Rahimahullah used to write taweedh for people and hang it on them.[3]

It is therefore incorrect to state that all taweedh lead to kufr and shirk. The view that all taweedh lead to kufr and shirk is the incorrect view of the Salafi who trespass the limit of balance and moderation in such issues. We also advise against attending the classes of such people.
