Paying transaction fee with the interest received from the ICICI bank

Dear Mufti shahab, Assalam Alaikum, I would like to know that can i compensate the transaction charges of any bank from the interest amount got from the same bank. Actually I am from India and i book my railway ticket from online reservation site. the online reservation site charges me some extra money as service charge, that is fine. But for the money transfer i use ICICI bank. this bank charges me extra money as a transaction charges for the money transfer to the railway site. so can i compensate this transaction charge money with the interest got from the same bank i.e. ICICI bank. Please let me know your valuable suggestion. JazakAllah, -Raza

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, it is impermissible to take interest or to give interest.

See the following hadith:

عَنْ جَابِرٍ، قَالَ: «لَعَنَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ آكِلَ الرِّبَا، وَمُؤْكِلَهُ، وَكَاتِبَهُ، وَشَاهِدَيْهِ»، وَقَالَ: «هُمْ سَوَاءٌ»

Translation: Jabir Radhi Allahu Anhu narrates that Nabi Sallalahu Alaihi Wasallam cursed the accepter of interest and its payer, and one who records it, and the two witnesses, and he said: They are all equal.

(Saheeh al-Muslim)[i]

 

If one was involved in dealing with interest and received interest money, the interest money must be returned to its original owner (the one from whom it was received). If that is not possible as in the situation of receiving interest from the bank, then one must dispose of interest received by giving it in charity without the niyyat of thawab. [ii]

In the enquired situation, there is leeway to pay ICICI bank transaction fees with the interest funds accrued only from ICICI bank. In essence, he is returning the interest received from ICICI bank to ICICI bank.[iii]

و أحل الله البيع و حرم الربو (البقرة : 275)

عن أبي هريرة رضي الله عنه قال قال رسول الله صلى الله عليه وسلم الربوا سبعون حوبا أيسرها ان ينكح الرجل أمه

درهم ربوا ياكله الرجل وهو يعلم أشد من ستة وثلاثين زنية
