Can ones immature nephew serve as ones Mahram?

Q. As salaam wa alaikum Insh I plan on goin for umrah with my sister and my nephew who is our mahram, however I hav a 10 year old son and an 8 year old daughter would my daughter be able to accompany us. The mahram of the trip for my sister and I would be my nephew who is baalig however my daughter is 8 years old ( who is not baalig) and my son is 10 yrs old would they be able to join us on the trip? Jazak


A. Your sister’s mature son (your nephew) qualifies as a valid Mahram for your sister and you. As such, he may travel the shari’ distance of travel/Umrah as a Mahram with the both of you.

On the other hand, if your son is immature (not Baaligh), he cannot serve as a Mahram for your daughter. At the same time, your nephew cannot serve as a valid Mahram for your daughter as he is a stranger to her.

Accordingly, your immature son may accompany you; however, a valid Mahram will have to be arranged for your daughter to accompany you on the trip. (Hindiyyah 1/218/219)
