Is it permissable to deduct wages for work related issues?

Assalam ‘alaikum,

Dear respected mawlana,
I hope you are in the best state of health and Iman.

My question is regarding the issue of financial penalties imposed by a Muslim employer upon his workers due to any shortcomings from the side of the employee. As a general rule I understand that التعزير بالمال is impermissible in the Hanafi madhhab. So can you please clarify whether it is permissible for an employer to cut the wages of a worker for any work related issue.

The shar’ee view is that a labourer’s wages should be given in his hand before his sweat dries.

A wage is a promise and a contract which must be fulfilled. Therefore, it would be impermissible to deduct from his wages for any errors committed.

If the deduction is due late comings, it would be allowed because this is a commonly agreed factor.

However, if there is any dmaage done by the employee, he should be given full wage and then charged for the repairing of the damage etc

The law of the land should also be kept in mind that this type of deduction is not allowed in our country.
