My wife has problems related to monthly periods.this exist before the at marriage,they conceal this problem and not told. during this period lot of treatment done for the purpose of children till not get the positive results and doctor told that pregnancy is difficult.In this situation can i go for second marriage as am employee of public sector undertaking. My wife’s relatives are threatening me not go for second marriage you have to wait for another 20 years to see. I am ready to maintain two wifes as per Islamic Shariah. Please give solution to my problem.
الجواب وبالله التوفيق
In the Islamic Shari‘ah a man is allowed to perform more than one Nikah, no one has a religious right to take this right away from him. However in case of more than one Nikah it is incumbent upon the husband to keep justice and equality between the wives in every aspect of life including paying their living expenses, spending nights with them etc. Otherwise on the day of judgement there will be severe consequences and accountability inflicted upon him. Therefore the actual permission to perform more than one Nikah is with these binding conditions of justice and equality.
فَانْكِحُوۡا مَا طَابَ لَـكُمۡ مِّنَ النِّسَآءِ مَثۡنٰى وَثُلٰثَ وَرُبٰعَ ۚ فَاِنۡ خِفۡتُمۡ اَلَّا تَعۡدِلُوۡا فَوَاحِدَةً اَوۡ مَا مَلَـكَتۡ اَيۡمَانُكُمۡ ؕ ذٰ لِكَ اَدۡنٰٓى اَلَّا تَعُوۡلُوۡا ؕ(النساء،3
(ویحب ان یعدل فیہ ای فی القسم بالتسویۃ فی البیتوتہ، و فی الملا لبس والماکول والصحبۃ (کتاب النوازل، ص 199، ج9 بحوالہ در مختار
