Did Divorce Take Effect?

Assalamualaikum Warahmatullah 

If a person tells his wife that “There is no need for you, and you are not needed”, what effect would that statement have over their Nikah. Would a divorce take place due to this statement? If yes, what should be done in that situation?

It has been mentioned in Fatawah Darululoom that such statements are considered figurative speech and the ruling about them in the Islamic Shari‘ah is if the person had an accompanying intention to divorce his wife by making this statement, the divorce would take effect. If he did not have an intention to divorce his wife thorugh this statement then the divorce would not take effect. The husband should be enquired about his statement and if he did not have an intention to divorce then the divorce would not take place. If however, he did have the intention to divorce then the wife will become divorced through one Talaq-e-Ba‘in (irrevocable divorce). In this case, there is no ruju (i.e. reconciliation) however if you want to live together, you can do so by performing Nikah with a new mehr amount.

لایقع الطلاق بشي من الکنایات إلابالنیۃکذا لوقال لا حاجۃ لی فیک (خانیۃ علی ہامش الہندیۃ زکریا ۱/۴۶۸)جدید۱/۲۸۴)

وَمِثْلُهُ قَوْلُهُ لَمْ أَتَزَوَّجْك أَوْ لَمْ يَكُنْ بَيْنَنَا نِكَاحٌ ، أَوْ لَا حَاجَةَ لِي فِيك بَدَائِعُ لَكِنْ فِي الْمُحِيطِ ذَكَرَ الْوُقُوعَ فِي قَوْلِهِ عِنْدَ سُؤَالِهِ .قَالَ : وَلَوْ قَالَ : لَا نِكَاحَ بَيْنَنَا يَقَعُ الطَّلَاقُ وَالْأَصْلُ أَنَّ نَفْيَ النِّكَاحِ أَصْلًا لَا يَكُونُ طَلَاقًا بَلْ يَكُونُ جُحُودًا وَنَفْيُ النِّكَاحِ فِي الْحَالِ يَكُونُ طَلَاقًا إذَا نَوَى وَمَا عَدَاهُ فَالصَّحِيحُ أَنَّهُ عَلَى هَذَا الْخِلَافِ (رد المحتار:۱۱/۱۲۴)
