Making Claims on One’s Car Insurance

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Abdurrahman ibn Yusuf Mangera

In UK you have to have car insurance if you own a car. As a law I know that you have to have a car insurance. Now if you have an accident can you make a claim?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Assalamu alaykum

In the name of Allah, the Inspirer of truth.

Since you have paid premiums on the policy, it would be permissible for you to make a claim and utilize the amount equal to the total amount of premiums you have paid so far to that company. Any more received should be disposed of by giving to the poor without the intention of reward.

And Allah knows best.

Wassalam

Abdur-Rahman ibn Yusuf
