Ihram Violations & Penalties

It is a condition to enter into a state of iḥrām (pilgrim sanctity) in order for the other main umrah rites to count. In other words, it is obligatory to enter into a state of iḥrām and the umrah will be invalid without it.

The details of the iḥrām were discussed at length in our FREE course: Umra For Women.

Obligatory (Fard) Elements of the Iḥrām

Entering into a state of iḥrām for umrah consists of:

  • making the intention to perform umrah
  • and chanting the talbiya in an audible voice.

This must be done before passing one’s respective designated boundary (miqāt).

Once one enters into a state of iḥrām, one cannot release oneself from it without first completing the remaining rites.

It must be mentioned that one must enter into a new state of iḥrām for each umrah that one performs.

Incurring Penalties

Once one officially enters into a state of iḥrām, the iḥrām prohibitions immediately come into effect.

If one violates the prohibitions, a prescribed penalty is due for each violation committed. Penalties are due irrespective of whether any of the following acts were done purposely, forgetfully, mistakenly, or because of an excuse. Yet, the one who commits an iḥrām violation purposely is sinful and must perform tawba.

Depending on the violation, the penalty will either be to offer a sheep slaughtering or to give in charity.

The sheep slaughtering must be carried out within the haram (sacred precinct) in Makkah. It is not permissible to eat the meat from this slaughtering because it is a punishment for the violation committed.

Giving charity can be given anywhere. For most violations, the amount due for charity is the same amount as sadaqat al-fitr, namely half ṣā’ of wheat, which is about 2.2 kilos of wheat or its monetary value.

The iḥrām violations and their penalties are briefly summarized in the charts below. Please note that if these same violations were committedfor hajj the penalties owed may differ. Children who have not reached puberty do not owe penalties for any violations that were committed.

Make sure to consult a scholar for further details inshaAllah.
