Is my aunt still required to observe iddah after my uncle’s death if she is unable to have children?

Answered as per Hanafi Fiqh by Muftisays.com
salaam
my uncle has recently been died, my aunti (his widow) is not young but old (not too old but around 50s) she has not been able to produce any kids for ages. now is she still due to iddah? many say that it would be ‘sawab’ but she is not due to it.
wassalaam

Answer
Bismillah

Al-jawab billahi at-taufeeq (the answer with Allah’s guidance)

Yes, the laws of Iddah will apply.

Allah Ta’ala says,

“And those of you who die and leave wives behind them, they (the wives) shall wait (as regards their marriage) for four months and ten days, then when they have fulfilled their term, there is no sin on you if they (the wives) dispose of themselves in a just and honourable manner (i.e. they can marry). And Allah is Well-Acquainted with what you do.” (2:234)

She is not permitted to leave home within the Iddah period except in the case of dire necessity.

And Only Allah Ta’ala Knows Best.
