Asking for Khula’ due to Husband being Impotent

Q: If somebody’s husband is impotent then is it permissible to ask for khula? Is impotency a valid reason to ask for khula?

A: If a wife’s marital rights are not being fulfilled due to the husband being impotent and the wife fears that she will not be able to fulfill  the rights and obligations of the nikah, then under such circumstances it will be permissible for the wife to seek khula’ from her husband.

وإذا تشاق الزوجان وخافا أن لا يقيما حدود الله فلا بأس بأن تفتدي نفسها منه بمال يخلعها به لقوله تعالى { فلا جناح عليهما فيما افتدت به } فإذا فعلا ذلك وقع بالخلع تطليقة بائنة ولزمها المال لقوله عليه الصلاة والسلام الخلع تطليقة بائنة. (الهداية 2/404)
