Q: Our Nikah was conducted by a Barelwi Imam as my wife’s family follow them. Is there anything to worry about, such as the validity of the nikkah due to it been conducted by a barelvi imam? I don’t think I have to investigate what exactly people’s beliefs or statuses are. Can I just assume the best and leave the matter?
A: If the nikah was performed in the presence of two muslim, baaligh male witnesses or one male and two female witnesses, the nikah is valid. If you have no knowledge of the person’s beliefs being corrupt (who performed the nikah), then there is no need to have any doubts.
وأما شروطه… ومنها الشهادة قال عامة العلماء إنها شرط جواز النكاح هكذا في البدائع وشرط في الشاهد أربعة أمور الحرية والعقل والبلوغ والإسلام… ويصح بشهادة الفاسقين والأعميين كذا في فتاوى قاضي خان… ويشترط العدد فلا ينعقد النكاح بشاهد واحد هكذا في البدائع ولا يشترط وصف الذكورة حتى ينعقد بحضور رجل وامرأتين كذا في الهداية ولا ينعقد بشهادة المرأتينبغير رجل وكذا الخنثيين إذا لم يكن معهما رجل هكذا في فتاوى قاضي خان ومنها سماع الشاهدين كلامهما معا هكذا في فتح القدير (الفتاوي الهندية 1/295-296)
قال ولا ينعقد نكاح المسلمين إلا بحضور شاهدين حرين عاقلين بالغين مسلمين رجلين أو رجل وامرأتين عدولا كانوا أو غير عدول أو محدودين في القذف. (الهداية 2/306)
