Distributing a plot that was jointly purchased

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I have a plot purchased by me and my sons income. The plot is on my eldest sons name. I have six children; three sons and three daughters. How it will be distributed…in my life or after?

Bismillaah

A: If money was used jointly as a partnership and the understanding was that it is a partnership then the plot will be a partnership according to each person’s contribution. Accordingly, if your contribution was one third for example, then one third is yours. Hence, in the case of death your heirs; children, parents, and wife etc. will inherit.

And Allah Ta’ala (الله تعالى) knows best.
