Q: I want to marry my wife’s niece who is 25 years old. I am 35 years old. I know that I cannot have both at the same time, but I have heard that one can marry another woman without giving divorce if he and his current wife have mutual consent not to have any physical relations. Please tell me if I can marry my wife’s niece as I stopped all physical relationship with my current wife.
A: It is not permissible for one to be married to a woman and her niece at the same time. The Hadith has strongly prohibited this. If one has to marry in this manner, then the nikaah of the second woman will not be valid. It is impermissible, regardless of whether the husband has relations with the first wife or not. Further, it is totally impermissible to deprive the first wife of her conjugal rights on account of deliberating marrying her niece.

(و) حرم (الجمع) بين المحارم (نكاحا) أي عقدا صحيحا (وعدة ولو من طلاق بائن، و) حرم الجمع (وطء بملك يمين بين امرأتين أيتهما فرضت ذكرا لم تحل للأخرى) أبدا لحديث مسلم «لا تنكح المرأة على عمتها» وهو مشهور يصلح مخصصا للكتاب (فجاز الجمع بين امرأة وبنت زوجها) أو امرأة ابنها أو أمة ثم سيدتها لأنه لو فرضت المرأة أو امرأة الابن أو السيدة ذكرا لم يحرم بخلاف عكسه.
قال الشامي: (قوله: أي عقدا صحيحا) الأنسب حذف قوله صحيحا كما فعل في البحر والنهر ولذا قال ح: لا ثمرة لهذا القيد فيما إذا تزوجهما في عقد واحد فإنه لا يكون صحيحا قطعا، ولا فيما إذا تزوجهما على التعاقب، وكان نكاح الأولى صحيحا فإن نكاح الثانية والحالة هذه باطل قطعا (رد المحتار 3/38)
(فإن تزوج أختين في عقدتين ولا يدري أيتهما أولى فرق بينه وبينهما) لأن نكاح إحداهما باطل بيقين
قوله: (لأن نكاح إحداهما باطل بيقين) يعني من كانت أخرى في الواقع (فتح القدير 3/214)
