Performing salaah behind a Masbooq

Q: What is the ruling about one joining a Masbooq in jamaat? Will the salaah be valid? Similarly, can one read his fardh salaah behind a person whose intention is a sunnat or nafl salaah?

Bismillaah

A: Performing Salaah behind a masbooq (one who stands up to complete his missed rakaats after the Imaam makes salaam) is impermissible. Similarly, performing Fardh Salaah behind one who is performing his sunnats is impermissible. The Salaah in both cases will be invalid and will have to be repeated. 

( و ) لا ( مفترض بمتنفل … ( و ) لا ( لاحق و ) لا ( مسبوق بمثلهما ) لما تقرر أن الاقتداء في موضع الانفراد مفسد كعكسه (الدر المختار 1/579-581)

( وشروط صحة الاقتداء أربعة عشر شيئا ) تقريبا … ( وأن لا يكون ) الإمام ( أدنى حالا من المأموم ) كأن يكون متنفلا والمقتدي مفترضا … ( ولا مسبوقا ) لشبهة اقتدائه
و في حاشية الطحطاوي : قوله ( لشبهة إقتدائه ) أي حال تحريمته وإنما لزمته القراءة لشبهة الإنفراد (حاشية الطحطاوي على مراقي الفلاح ص290)
