Accepting Gifts from One’s Students

Question:

Q1-Is it permissible for an Ustaadh to take gifts like sweets etc given by a-non mature b-mature  student, which the students have bought with there own pocket money?


Answer:

 

                  

 

  1. According to Shari’ah it is necessary for the endower to be matured in order for the deed of endowment (gift) to be correct.  Therefore it will not be permissible for the Ustaadh to accept a gift given to him by an immature child.  If the parents however purchase an item with their own money and instruct the child to present it as a gift to the Ustaadh then it will be permissible for him/her to accept the gift as in this case the parents are the actual endowers.  (Fataawaa Mahmoodiyah, Vol. 14, Page 407, Ad-Durrul Mukhtaar, Vol. 8, Page 489)

  1. It is permissible to accept a gift from a mature child who purchased it with his own pocket money.  (Ad-Durrul Mukhtaar, Vol. 8, Page 489)
