What are the circumstances for needing permission from parents for Jihad fi Sabeelillah?

Answered as per Hanafi Fiqh by Jamia Binoria
In which circumstances it is necessary to get the permission of parents to engage in Jihad fi Sabeelillah – الجہاد فی سبیل اللہ – and what are the circumstances where it does not become necessary to get their permission? Please explain in detail.

الجواب حامدا و مصلیا

In the prevailing circumstance, Kuffars and Hindus of Palestine, Bosnia, Iraq and Kashmir have oppressed and meted out tyranny on Muslims and governments of these countries without providing freedom of religion for Muslims, are in full cry to eradicate their religious customs, symbols and signs. Hence, Jihad has become Fardh e Ain in the said areas. Therefore in case the Muslims are not sufficient for the Jiahd in the areas mentioned such as Kashmir and Iraq etc., it becomes Fardh upon the Muslims who live in the adjoining areas to the extent that gradually in this order it could become Fardh on every Muslim around the world. But the interpretation of Jihad becoming Fardh e Ain does not mean at all that each Muslim in that area should carry weapons and proceed to the battle field and surround the enemy but, whatever is felt appropriate, should be planned and adopted skillfully. Accordingly, if the necessity is felt to send a group carrying weapons to the battlefield and to make another group engaged in helping them through other avenues, this plan too can be implemented. The idea behind the saying that the present day Jihad is not Fardh e Ain on other Muslims does not mean at any cost, that they just tie their hands and wait, but, it becomes their responsibility/duty according to AL MUSLIMOONA KULLUHUM KA JASADIN WAHID (All the Muslims are like a single body) to help and assist the oppressed Muslims of those areas physically and financially to the extent of their ability and courage as per the set out plans to put pressure upon Muslim rulers to take every possible action to force these non-Muslim rulers so that they take back their paw of tyranny from these oppressed Muslims and accept their fair demands and give them their religious rights. Likewise it is necessary upon them to make Dua too, in the presence of AllahTha’ala for the freedom of these tyrannized Muslims.
From the above mentioned explanation it is obvious that Jihad has not become Fardh e Ain upon every Muslim around the world but it is Fardh e Kifaya. Therefore obedience to the parents is essential and without their permission one should not engage in Jihad of Kashmir etc.. It is necessary to satisfy them and once they are satisfied should participate if they are are satisfied. Until such time they are saisfied, should help and assist the Mujahideens through other avenues, because it is found in plenty of incidents, from the treasure of Ahadees where some Sahabas Radhiyallahu Anhum who had come to participate in Jihad without parents’ permission, but Rasoolullahi Sallallahu Alaihi wa Sallam had emphasized them to serve their parents.
