Question:

If someone wants to go for Hajj with their mother, but they have outstanding accounts, is it permissible for them to go?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible for you to go for Hajj with your mother if you have control over your debts.If after servicing your current debts it is still affordable, then it is permissible for you to accompany your mother for Hajj. [1]

However, a woman can only travel a maximum of 48ml/78km without a mahram (a male with whom marriage is not permissible in Shariah). Therefore for you perform Hajj you are required by Shariah to be accompanied by a mahram (a male with whom marriage is not permissible in Shariah).[2]&[3]

[1] (قَوْلُهُ مِمَّنْ يَجِبُ اسْتِئْذَانُهُ) كَأَحَدِ أَبَوَيْهِ الْمُحْتَاجِ إلَى خِدْمَتِهِ وَالْأَجْدَادُ وَالْجَدَّاتُ كَالْأَبَوَيْنِ عِنْدَ فَقْدِهِمَا، وَكَذَا الْغَرِيمُ لِمَدْيُونٍ لَا مَالَ لَهُ يَقْضِي بِهِ، وَالْكَفِيلُ لَوْ بِالْإِذْنِ، فَيُكْرَهُ خُرُوجُهُ بِلَا إذْنِهِمْ كَمَا فِي الْفَتْحِ، وَظَاهِرُهُ أَنَّ الْكَرَاهَةَ تَحْرِيمِيَّةٌ وَلِذَا عَبَّرَ الشَّارِحُ بِالْوُجُوبِ، وَزَادَ فِي الْبَحْرِ عَنْ السَّيْرِ وَكَذَا إنْ كَرِهَتْ خُرُوجَهُ زَوْجَتُهُ وَمَنْ عَلَيْهِ نَفَقَتُهُ. اهـ. وَالظَّاهِرُ أَنَّ هَذَا إذَا لَمْ يَكُنْ لَهُ مَا يَدْفَعُهُ لِلنَّفَقَةِ فِي غَيْبَتِهِ قَالَ فِي الْبَحْرِ: وَهَذَا كُلُّهُ فِي حَجِّ الْفَرْضِ.(رد المحتار, ج 2, ص 456, سعيد)

وَأَبِي يُوسُفَ كَرَاهَةُ خُرُوجِهَا وَحْدَهَا مَسِيرَةَ يَوْمٍ وَاحِدٍ، وَيَنْبَغِي أَنْ يَكُونَ الْفَتْوَى عَلَيْهِ لِفَسَادِ الزَّمَانِ شَرْحُ اللُّبَابِ وَيُؤَيِّدُهُ حَدِيثُ الصَّحِيحَيْنِ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاَللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تُسَافِرَ مَسِيرَةَ يَوْمٍ وَلَيْلَةٍ إلَّا مَعَ ذِي مَحْرَمٍ عَلَيْهَا»
