Going for hajj/umrah with outstanding debts.

Answered as per Hanafi Fiqh by Askimam.org

A student living in england has taken loan and is pursuing bachelors degree . After graduating, if he/she is able to find a job which gives more than £21k a year, THEN the loan has to be paid back with interest. If job pays less than 21k a year, then no need to payback the loan. The debt also gets cleared after 30 years.

This person wants go for umrah/hajj.
1) Can this person go for haj/umrah.
2) will it be accepted?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The question of performing hajj/umrah and its acceptability is premised on the issue of having a loan, more so an interest bearing loan.

According to the premise, it is clear that the student is aware of the impermissibility of an interest bearing loan. The condition not to pay back if he earns lesser than £21k doesn’t exclude the loan from being an interest bearing loan. It will remain a sin for which necessary amends will have to be made.

Nevertheless, if one has an outstanding debt, that does not prevent him from performing hajj/umrah. He may go for hajj/umrah. His umrah/hajj will be considered valid[1].
