Permanent Watn Iqamah Query

Question

In relation to your answer entitled ‘Ṣalāh for regular traveller to the work place’, is it necessary for him to reside there for 15 days at least once before the rule of the continuity of Waṭn Iqāmah applies? In other words, if a person has never resided there for 15 days or more, he will always shorten his Ṣalāh there even if he has a residence there with his belongings?

Answer

For Waṭn Iqāmah to be established, a person must intend to stay for 15 days or more. Therefore, the rule of the continuity of Waṭn Iqāmah (with the conditions mentioned in the earlier Fatwa) will only apply once Waṭn Iqāmah is established. If Waṭn Iqāmah is never established, the traveller will shorten his Ṣalāh.

جاء في الأصل (١/٢٦٦): قلت: أرأيت إن سافر ثلاثة أيام فصاعدا فقدم المصر الذي خرج إليه، أيتم الصلاة؟ قال: إن كان يريد أن يقيم فيه خمسة عشر يوما أتم الصلاة، انتهى. وعلى هذا قال الحاكم الشهيد في الكافي: وأقل مدة الإقامة خمسة عشر يوما، كذا في المبسوط (١/٢٣٦). وقال القدوري في مختصره (ص ٣٨): ومن خرج مسافرا صلى ركعتين إذا فارق بيوت المصر، ولا يزال على حكم السفر حتى ينوي الإقامة في بلد خمسة عشر يوما فصاعدا فيلزمه الإتمام، وإن نوى الإقامة أقل من ذلك لم يتم، انتهى. وقال السمرقندي في التحفة (١/١٥٠): إذا نوى المسافر إقامة خمسة عشر يوما في مكان يصلح للإقامة فإنه يصير مقيما، فلا بد من ثلاثة أشياء: نية الإقامة ونية مدة الإقامة والمكان الصالح للإقامة، انتهى. وقال الكاساني في البدائع (١/١٠٣): ووطن الإقامة، وهو أن يقصد الإنسان أن يمكث في موضع صالح للإقامة خمسة عشر يوما أو أكثر، انتهى۔
