Salah of traveller who changes his mind to return home

A person leaves Blackburn with the intention of travelling to London. After travelling thirty miles, he changes his mind and begins to return home to Blackburn. Before arriving into Blackburn, if he performs Ṣalāh will he shorten his Ṣalāh? Would the ruling be different if he had travelled more than 48/54.5 miles?

Answer

If a person decides to return home and has travelled less than 48/54.5 miles, he will not shorten his Ṣalāh and is regarded as a muqīm (resident). However, if he has already travelled this distance, he will shorten his Ṣalāh until he does not enter his home town.

قال السرخسي في المبسوط (١/٢٣٨): وإن كان خرج من مصره مسافرا، ثم بدا له أن يرجع إلى مصره لحاجة له قبل أن يسير مسيرة ثلاثة أيام، صلى صلاة المقيم في انصرافه، لأنه فسخ عزيمة السفر بعزمه على الرجوع إلى وطنه، وبينه وبين وطنه دون مسيرة السفر، فصار مقيما من ساعته، بخلاف الأول، فإنه ماض على سفره ما لم يدخل مصره، انتهى. وقال السمرقندي في تحفة الفقهاء (١/١٥٣): أما الرابع، فهو العزم على العود إلى مصره بأن خرج من مصره بنية السفر ثم عزم على العود إلى مصره ولم يكن بين هذا الموضع الذي بلغ وبين مصره مدة سفر، فإنه يصير مقيما حين عزم على العود إلى مصره وإن لم يدخل مصره ولا نوى الإقامة صريحا، ويصلي أربعا ما لم يعزم على السفر ثانيا، وإذا كان بينه وبين مصره مدة سفر لا يصير مقيما، انتهى. ونحوه في فتاوى قاضي خان (١/١٤٨) والمحيط البرهاني (٢/٣٥)۔
