Removing Pubic Hair

My son is 20 years old and has severe learning difficulties. As part of supported living, he lives in a care home. The care home that are looking after him are claiming that it is not necessary to remove his pubic hair because he lacks capacity to understand this ruling. However, we feel that he has some capacity to understand what is required and not required particularly in relation to hygiene. Further, if the explanation is simple using basic language, he understands. In addition, as parents, it is our desire that he adheres to the Islamic guidelines on hygiene. Please can you explain the Islamic position in relation to the removal of pubic hair and the time-frame so we can share with the care home. In addition to this, should we ask the care home to remove his public hair?

Answer

(1) Islam regards the removal of pubic hair from one’s natural disposition (Ṣaḥīḥ al-Bukhārī, 5891). Further, some jurists suggest that removing the pubic hair is from the signs of Muslims (Badāʾiʿ al-Ṣanāʾiʿ, 1:303). It is recommended to remove the pubic hair once a week. If this is not possible, then it is permissible to remove it every fifteen days. If this is not possible, then the maximum permitted time limit is forty days. It is prohibitively disliked to exceed this time limit of forty days (Ṣaḥīḥ Muslim, 258; Radd al-Muḥtār, 6:407). Therefore, if your son has the understanding to remove his pubic hair himself for example via the use of a cream, he should be advised to do so.

(2) If your son lacks the understanding and capacity to remove his pubic hair, he will not be accountable for this as he is not mukallaf (responsible). In this scenario, we would advise against the care home undertaking this, to ensure this does not become a means of abuse. It is an unfortunate fact that abuse does occur in some care homes. However, if you as parents are able to remove his pubic hair, there is no harm in you doing so.

١) عن أبي هريرة رضي الله عنه سمعت النبي صلى الله عليه وسلم يقول: الفطرة خمس: الختان، والاستحداد، وقص الشارب، وتقليم الأظفار، ونتف الآباط، رواه البخاري (٥٨٩١). وقال الكاساني في البدائع (١/٣٠٣): علامة المسلمين أربعة أشياء: الختان والخضاب ولبس السواد وحلق العانة، انتهى. وعن أنس بن مالك قال: وقت لنا في قص الشارب وتقليم الأظفار ونتف الإبط وحلق العانة أن لا نترك أكثر من أربعين ليلة، رواه مسلم (٢٥٨). وقال ابن عابدين في رد المحتار (٦/٤٠٧) تحت قول الحصكفي (وكره تركه وراء الأربعين، مجتبى): أي تحريما لقول المجتبى: ولا عذر فيما وراء الأربعين ويستحق الوعيد اهـ وفي أبي السعود عن شرح المشارق لابن ملك روى مسلم عن أنس بن مالك: وقت لنا في تقليم الأظفار وقص الشارب ونتف الإبط (وحلق العانة) أن لا نترك أكثر من أربعين ليلة، وهو من المقدرات التي ليس للرأي فيها مدخل فيكون كالمرفوع اهـ، انتهى. وقال عبد الرحمن شيخي زاده في مجمع الأنهر (٢/٥٥٦): وفي القنية: ويستحب حلق عانته وتنظيف بدنه بالاغتسال في كل أسبوع مرة، فإن لم يفعل ففي خمسة عشر يوما مرة، ولا عذر في تركه وراء أربعين، انتهى. وزاد في رد المحتار (٢/١٨١) والفتاوى الهندية (٥/٣٥٨) عن القنية: ويستحق الوعيد. وزاد ابن عابدين عن القنية: فالأول أفضل والثاني الأوسط والأربعون الأبعد، انتهى. وقال الطحطاوي في حاشية المراقي (ص ٥٢٤): وفي استحسان القهستاني عن الزاهدي: يستحب أن يقلم أظفاره ويقص شاربه ويحلق عانته وينظف بدنه في كل أسبوع مرة ويوم الجمعة أفضل ثم في خمسة عشر يوما والزائد على الأربعين آثم اهـ، انتهى۔

٢) قال في الفتاوى الهندية (٥/٣٥٨): وحلق الحجام جائز إن غض بصره، كذا في التتارخانية (١٨/٢١٣). وقال ابن الهمام في فتح القدير (١/٤٧٦) والحصكفي في الدر المختار (٢/٥٧): درء المفسدة مقدم على جلب المصلحة، انتهى. وقال الكشميري في فيض الباري (١/٣١٧): الإنسان أرغب في دفع المضرة من جلب المنفعة، انتهى. وقال ابن نجيم في الأشباه والنظائر (ص ٧٨) والطحطاوي في حاشية المراقي (ص ٤٩) واللفظ له: درء المفاسد مقدم على جلب المصالح غالبا، واعتناء الشرع بالمنهيات أشد من اعتنائه بالمأمورات، انتهى. ونحوه في التقرير والتحبير (٣/٢١)۔
