Marriage of insane person

A boy has always been insane. He cannot make his own decisions. He is currently twenty years old. His parents want him to get married and a suitable partner has been found. What is the process and is it possible for him to be married?

Answer

An insane person who is unable to make decisions for himself can be married to someone else by the closest guardian, which in this case is the father. The father will act as his representative and can marry him.

قال محمد في الأصل (١٠/١٨٧، طبعة قطر): وإذا زوج الرجل ابنه وهو صغير أو ابنته وهي صغيرة، فالنكاح جائز لازم لكل واحد منهما، ولا خيار لهما إذا أدركا. وقال (١٠/١٩٣): والمجنون المغلوب بمنزلة الصبي في ذلك كله. قال السرخسي في المبسوط (٤/٢٢٨): ويستوي إن كان جنونه أصليا أو طارئا، انتهى. وقال الحصكفي في الدر المختار (٣/٥٦): (وهو) أي الولي (شرط) صحة (نكاح صغير ومجنون)۔
