Am I divorced

assalamualaikum
I have received the following text from my husband
”you and I are no longer compatible, nor are we moving in the same direction. Out life goals are completely different. I would be lying if I said I wanted to continue in a marriage with you. I will do right by ***** (daughters name withheld) within reason. It’s time to go our separate ways”
I then didn’t have contact with my husband for over 4 months, Is this a divorce.

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

Your husband wrote ambiguous words. As such, divorce will not take place if he had the intention of divorce when writing that text.

If he did not intend divorcing you when typing that text, no divorce will fall.

It does not matter that you are not living with him for so long. That will not alter the ruling.

باب الكنايات (كنايته) عند الفقهاء (ما لم يوضع له) أي الطلاق (واحتمله) وغيره (ف) الكنايات (لا تطلق بها) قضاء (إلا بنية أو دلالة الحال) وهي حالة مذاكرة الطلاق أو الغضب (الدر المختار – 3/ 296)
