If the Area Below a Masjid Is Excluded From the Masjid Boundaries Before the Masjid Is Made Waqf

Question:

If the area below a masjid is excluded from the Masjid boundaries before the masjid is made waqf, can a haaidhah come and sit in that area (asking due to some restrictions always remain eg no toilets allowed nor can imams family residence be made there)

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

Usually, the part above and below a Masjid is considered to be part of the Masjid (Raddul Mukhtar, Vol 6, Pg 547). However, if the area below the Masjid was excluded from the boundaries of the Masjid prior to it being made Waqf, as in your question, it will not have the same rulings as a Masjid, as it is not considered to be a part of the Masjid. Therefore, a Haaidah can sit in that area.

حاصله أن شرط كونه مسجدا أن يكون سفله علوه مسجدا لينقطع حق العبد عنه لقوله تعالي وَ أَنَّ الْمَسَاجِدَ لِلّٰهِ

إذا جعل تحته سردابا لمصالحه أي المسجد جاز كمسجد القدس لو جعل لغيره أو جعل فوقه بيتا جعل باب المسجد إلي طريق وعزله عن ملكه لا يكون مسجدا
