Is It Still Incumbent on the Husband To Maintain His Divorced Wife in Her Iddah Which Was Done Through Kula?

Question:

Is it still incumbent on the husband to maintain his divorced wife in her iddah which was done through kula’

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

Providing accommodation and maintenance for the period of idda is obligatory on the husband whether the divorce took place via khul’a or ordinary divorce initiated by the husband as long as the wife remains in the husband’s home during that time.1 An exception is if the husband and wife agreed to khul’a on the condition that the husband would not provide accommodation (sukna) and maintenance (nafaqa) then she would be still entitled to accommodation and not maintenance.2
