Wages for treating patients

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Wages for treating patients

In the name of Allah, the most Beneficent, the most Merciful.

Answer

Taking wages for treating patients is like a leasing contract.  If the following conditions are found it will be permissible.

  1. The lessee and the lessor have to be sane, mature and of an understanding age
  2. Consent from both the lessee and lessor
  3. The benefit has to be known. With regards to your situation the treatment you intend to give the patients should be communicated to them.
  4. The wages should be known. The patients should know how much he or she would be paying for the treatment. (Jadeed Muamlaat Ke Shari Ahkaam p.197 v.1)

As you are treating patients who are living in a nursing home then the aforementioned conditions needs to be found between yourself and the nursing home and not necessarily between the patients. The nursing home will act as an agent on the patient’s behalf.
