Question:

Can step-sons inherit from a step-mother. What is the right of the husband, daughter and step-sons in regards to inheritance.
eg:
Husband and Wife have a daughter, but the husband has 2 sons from a previous marriage. If the wife has passed away, what is the ruling regarding the islamic inheritance share of the living persons - daughter, husband and step-sons. how is the inheritance shared out?
Answer

بسم الله الرحمن الرحيم

There are no ties of inheritance between a stepmother/stepfather and his/her stepchildren.

(Kitaabul Meeraath P63)

If there are absolutely no other relatives or heirs at all for the deceased besides a husband and daughter, the estate will be divided as follows:

Husband 25%

Daughter 75%

(Chapter of Radd, Kitaabul Meeraath P92)
