Is it legal to marry a girl in court and then do a Nikah in front of witnesses without her parents’ presence?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalam Alykum, I like a girl since last 8 years and She also likes me and we want to get married.I told it to my family, so my elder brother proposed it to girl’s father, but he refused because I am from Bihar and they are from Utter pradesh. Now, girl’s parrents are searching other boy for her marriage. If I will married with the girl in court and after that we will do NIKAH also in front of 3-4 witnesses, is it legal according to Islam? Is it mendatory, presence of girl’s parrents. I am 30 years old and in good job. girl is 24 years old. Please help me what I should do, I am in too much tension.

Answer

(Fatwa: 1187/1187=M/1430)

If mature boy and girl are match for each other (kufu) and the nikah is solemnized in the presence of two witnesses, the nikah will take place. But it is obscenity and shamelessness to marry in court without the consent of parents. It is unlawful to meet and talk to a girl whom you love. And when her father denied your proposal of marriage, you should let her off your mind and should not think of marriage with her. Act upon the advices of your parents and it is better to perform istikharah too. Try to follow the Shariah, in-sha-Allah you will be granted prosperity and blessing.
