Is the talaq valid after the baby is born?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My sister was married in 2008. She is pregnant and her husband is not aware about her pregnancy. Last week, we have received a letter. In the letter her husband mentioned three time talaq and signature of a Maulana and two other persons. Now we have confusion about validity of this talaq. Could you please guide us in this issue? Will this talaq be valid after delivery? Please suggest.

Answer

(Fatwa: 1729/1729/M=1432)

It should be discussed with the husband of sister. If he confirms and accepts the letter of three talaqs which he sent, then three talaqs shall occur on your sister. And talaq takes place in the state of pregnancy as well. If your sister was pregnant at the time of talaq writing, then her iddah shall be over when she will give birth to child.
