salam valey kum the property/cash left by parents has not been distributed so far due dispute among the sons.by default the same is in the physical custody of one of them. who will pay zakat?

First of all, the property should be divided as per the Shariah and every heir should pay his Zakah of the concerning years:
ومثلہ ما ورث دینا علی رجل، وفي الشامي: أي مثل الدین المتوسط فیما مر ونصابہ من حین ورثہ (الدر المختار مع الشامی 3:238)
