What is the difference between Makrooh and Haram?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
I wanted to know the difference between makrooh and haram. I also wanted to know the difference between fardh and wajib. As I have qaza salah in my account, do I have to offer the qaza of witr wajib as well?

Answer

(Fatwa: 346/359/N=1433)

(1) Haram is the last status of prohibition, and makrooh tahrimi is near unlawfulness and far from lawfulness. And makrooh tanzihi is near lawfulness and far from unlawfulness. Such is mentioned in al-Dur O al-Radd (Kitab al-Hadhar wal Ibahah, Vol. 9, p 486-487)
(2) Fardh is the last and obligatory status of commandment and wajib is near to it i.e. with reference to practice both are binding but with reference to belief there is some difference between them. A person who denies fardh he is kafir and a person who denies wajib he is only fasiq and deviant. He may not be declared as kafir. (So it is mentioned in al-Dur al-Radd, Kitab al-Taharah, Vol. 1, p 207-208)
(3) The qaza of witr is obligatory like fardh. In case one does not offer missed witr one shall be sinful. (So it is mentioned in al-Dur al-Radd, Kitab al-Salah, Bab al-Wirt and al-Nawafil, Vol. 2, p. 440-441)
