Is it permitted in Shariah for a woman whose husband has been missing for two years to remarry?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
One woman got married 5 years back. But her husband has gone missing from last 2 years. Now is it allowed in Shariah for that woman to get remarried? If it is allowed then after how many years? How many years would she wait for her husband?

بسم الله الرحمن الرحيم

(Fatwa: 1358/L-462/TL=11/1434)

In the above mentioned case, if the husband of the said woman is missing in a way that nothing is known about his death or life then the woman should file her case in Shariah Panchayat. If the Shariah Panchayat after searching the missing husband nullifies the nikah as per the guidelines of Al-Heelah Al-Najizah then the woman may marry anywhere after passing her iddah.
