Abortion and Pregnancy out of Wedlock

Answered as per Hanafi Fiqh by Askmufti.co.za
Q: I am a 35 year old unmarried lady. I have made many attempts to marry all of which have failed. Recently I went abroad and lost my virginity with a 22 year old Hindu. I am now 2 months pregnant, he does not want me or the child and is forcing me to have a abortion. I am unemployed, and would have to rely on charity to have this child. Also my parents will be caused great embarresment because of my misdeeds. Can I have anabortion?

A. An abortion in your circumstance will be permissible up to one hundred and twenty days of pregnancy and not thereafter. Make Istighfaar and Taubah in abundance for this error. May Allah Ta’aala have mercy on you, Aameen.

After 120 days (4 months) the soul is introduced into the foetus, therefore it is Haraam and a major sin to abort the foetus after this period. Even now, the abortion you want to have is due to your own mistakes. You will be allowed to have this abortion, but need to repent and make abundant Istighfaar.

And Allah knows best
