Q: What rights does a wife have in deciding where the home location should be?
A. Although the final decision in this issue belongs to the husband, Shari’ah has encouraged Mashwarah (mutual consultation). Seeing that such a move also affects her, it should be discussed with her and her opinion and feelings in this regard should be taken into consideration. Both husband and wife being pleased with the location will enhance harmony and understanding.
Mufti Siraj adds:
However in one aspect the wife has the final say in accommodation, and that is security. The wife is entitled to live in a place that is secure and safe, and where there are good, reliable neighbours, as mentioned in the Works of Fiqh. This is her exclusive right which the husband must honour.
