Using Interest for Building

Q: I have been having my kitchen extension built. The non-Muslim builder told me the roof window which opens is not available anywhere, so he fitted a window which doesn’t open. All monies for window and all building work was paid by me in one total amount as agreed on contract. After a few weeks of fitting I found window which does open, but the builder told me I have to pay again for the new openable window. My question: The old window was paid, fitted, but not used by me at all, and a few weeks later changed and fitted for a new openable window paid by me again. Can I re-imburse the amount for the old window with interest money because I did not use it and the builder removed it and took it away for his use?

A: You cannot use interest money to reimburse the cost of the old window. You can claim the money from the builder if possible, for he is the one who took the window.
