I would appreciate if you can please provide responses to the below questions.

1. If someone is sick and his/her parent lives with a sibling at a drivable distance and the paernt calls and asks the person’s wellbeing, but does not visit t helpout. In this situation, if the person compains to their spouse about how they are ignored by their parent and how they never come to help out/pamper/make feel cared for, then does this count as gheebat? 

2.If someone shopped online for clothes and later upon the purchase found some animate objects in the print, then can they still wear the garment when not praying salah? If not, then what should we do with it?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

  1. It is an obviously well-known fact that children should display love and respect to their parents in each and every way, including while addressing them.

Shariah emphasizes the importance of respecting one’s parents. Always show respect to them. Do not let anything affect your relationship with your parents.

Consider the following: Allah (Subhaanahu wa Ta’āla) says: 

ووصينا الانسان بوالديه احسانا

“And we have enjoined upon Mankind showing compassion to parents” (Surah al- Ankabūt, chapter 29, verse 8)

The aforementioned verse clearly advocates the importance of showing respect to ones parents.

Always examine yourself when dealing with your parents to see whether you have violated this cardinal principle or not.

Rasulullah (Sallallahu Alayhi Wasallam) said:

فَالْزَمْهَا، فَإِنَّ الْجَنَّةَ تَحْتَ رِجْلَيْهَا[1] 

“Hold firmly onto her, for verily Jannah lies under the feet of the mother”. (Sunan al- Nasa’ie, Vol.6, Pg.11, Al- Matboo’aath al – Islamiyyah, second edition, 1406)

As such, one should always think positive in issues related with parents.

You have stated that your parent calls you and ask about your wellbeing. It is clear from this that your parent have lots of mahabbah for you. Your parents not coming to visit you does not mean they do not like you. Let not shaytān whisper negative thoughts in your heart that could deprive you from the duaa’s and blessings of your parents.  

Furthermore, gheebat is to speak something about a person behind his back that he/she dislikes (being spoken about).[2] If you think the statement you made regarding your parents will offend and displease them, then it would be considered as gheebat, you should make tawbah and abstain from making such statements.

  1. It is not permissible to wear clothes having pictures of animate on them, weather in salāh or out of salāh. Consider the following:

3226 – حَدَّثَنَا أَحْمَدُ، حَدَّثَنَا ابْنُ وَهْبٍ، أَخْبَرَنَا عَمْرٌو، أَنَّ بُكَيْرَ بْنَ الأَشَجِّ حَدَّثَهُ، أَنَّ بُسْرَ بْنَ سَعِيدٍ حَدَّثَهُ، أَنَّ زَيْدَ بْنَ خَالِدٍ الجُهَنِيَّ رَضِيَ اللَّهُ عَنْهُ حَدَّثَهُ، وَمَعَ بُسْرِ بْنِ سَعِيدٍ عُبَيْدُ اللَّهِ الخَوْلاَنِيُّ الَّذِي كَانَ فِي حِجْرِ مَيْمُونَةَ رَضِيَ اللَّهُ عَنْهَا زَوْجِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، حَدَّثَهُمَا زَيْدُ بْنُ خَالِدٍ، أَنَّ أَبَا طَلْحَةَ حَدَّثَهُ أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، قَالَ: «لاَ تَدْخُلُ المَلاَئِكَةُ بَيْتًا فِيهِ صُورَةٌ» قَالَ بُسْرٌ: فَمَرِضَ زَيْدُ بْنُ خَالِدٍ فَعُدْنَاهُ، فَإِذَا نَحْنُ فِي بَيْتِهِ بِسِتْرٍ فِيهِ تَصَاوِيرُ، فَقُلْتُ لِعُبَيْدِ اللَّهِ الخَوْلاَنِيِّ: أَلَمْ يُحَدِّثْنَا فِي التَّصَاوِيرِ؟ فَقَالَ: إِنَّهُ قَالَ: إِلَّا رَقْمٌ فِي ثَوْبٍ أَلاَ سَمِعْتَهُ قُلْتُ لاَ، قَالَ: بَلَى قَدْ ذَكَرَهُ (صحيح البخاري)

Hazrat Busr bin Sa`id (radiallahu anhu) narrates:

That Zaid bin Khalid Al-Juhani (radiallahu anhu) narrated to him something in the presence of Sa`id bin ‘Ubaidullah Al- Khaulani (rahimahullāh) who was brought up in the house of May’mūnā (radiallahu anha) the wife of the Prophet (sallallahu alayhi wasallam). Zaid (radiallahu anhu) narrated to them that Abu Talha (radiallahu anhu) said that the Prophet (sallallahu alayhi wasallam) said, “The Angels (of Mercy) do not enter a house wherein there is a picture.” Busr (rahimahullāh) said, “Later on Zaid bin Khalid (radiallahu anhu) fell ill and we called on him. To our surprise, we saw a curtain decorated with pictures in his house. I said to Ubaidullah Al-Khaulani (rahimahullāh), “Didn’t he (i.e. Zaid radiallahu anhu) tell us about the (prohibition of) pictures?” He said, “But he excepted the embroidery on garments. Didn’t you hear him?” I said, “No.” He said, “Yes, he did.” (Bukhari: 3226)

However, if the image is so small that if it were to be placed on ground, and a standing person would not be able to distinguish its features, or the image is headless (because an animate being cannot live without a head), or the image is so distorted that no features can be distinguished, then it would be permissible to wear such clothes.[3]

70 -(2589) حَدَّثَنَا يَحْيَى بْنُ أَيُّوبَ، وَقُتَيْبَةُ، وَابْنُ حُجْرٍ، قَالُوا: حَدَّثَنَا إِسْمَاعِيلُ، عَنِ الْعَلَاءِ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، قَالَ: «أَتَدْرُونَ مَا الْغِيبَةُ؟» قَالُوا: اللهُ وَرَسُولُهُ أَعْلَمُ، قَالَ: «ذِكْرُكَ أَخَاكَ بِمَا يَكْرَهُ» قِيلَ أَفَرَأَيْتَ إِنْ كَانَ فِي أَخِي مَا أَقُولُ؟ قَالَ: «إِنْ كَانَ فِيهِ مَا تَقُولُ، فَقَدِ اغْتَبْتَهُ، وَإِنْ لَمْ يَكُنْ فِيهِ فَقَدْ بَهَتَّهُ» (الصحيح لمسلم)

الغيبة أن تصف أخاك حال كونه غائبا بوصف يكرهه إذا سمعه.

عن أبي هريرة رضي الله عنه قال: قال عليه الصلاة والسلام: أتدرون ما الغيبة؟ قالوا: الله ورسوله أعلم، قال: ذكرك أخاك بما يكره، قيل: أفرأيت إن كان في أخي ما أقول؟ قال: إن كان فيه ما تقول اغتبته، وإن لم يكن فيه فقد بهته، وإذا لم تبلغه يكفيه الندم، وإلا شرط بيان كل ما اغتابه به. الدر المختار شرح تنوير الأبصار وجامع البحار (ص: 665) دار الفكر-بيروت

إلا أن تكون صغيرة” بحيث لا تبدو للقائم إلا بتأمل كالتي على الدينار لأنها لا تعبد عادة ولو صلى ومعه دراهم عليها تماثيل ملك لا بأس به لأن هذا يصغر عن البصر “أو” تكون كبيرة “مقطوعة الرأس” لأنها لا تعبد بلا رأس “أو” تكون “لغير ذي روح” كالشجر لأنها لا تعبد…

قوله: “فيه تصاوير ذي روح” قيد به لأن الصورة تكون لذي الروح وغيره والكراهة ثابتة ولو كانت منقوشة أو منسوجة وما كان معمولا من خشب أو ذهب أو فضة على صورة إنسان فهو صنم وإن كان من حجر فهو وثن قوله: “لأنه يشبه حامل الصنم” هذه العلة تنتج كراهته ولو في غير صلاة ونقله في النهر عن الخلاصة قوله: “أو بحذائه” أي عن يمينه أو عن يساره قوله: “كالتي على الدينار” ومثلها الصورة المنقوشة في خاتم غير مستبينة أفاده في المحيط وقد روي أن خاتم أبي هريرة كان عليه ذبابتان وخاتم دانيال كان عليه أسد ولبوة وبينهما صبي يلحسانه وذلك أن يختنصر قيل له يولد مولود يكون هلاكك على يديه فجعل يقتل من يولد فلما ولدت أم دانيال دانيال ألقته في غيضة أي أجمة رجاء أن يسلم فقيض الله له أسدا يحفظه ولبوة ترضعه فنقشه على خاتمه ليكون بمرأى منه ليتذكر نعمة الله عليه ووجد ذلك الخاتم في عهد عمر رضي الله عنه فدفعه عمر إلى أبي موسى الأشعري كذا في الشرح والتقييد بغير المستبين يفيد أن المستبين في الخاتم تكره الصلاة معه كذا في المنح قوله: “مقطوعة الرأس” لا تزول الكراهة بوضع نحو خيط بين الرأس والجثة لأنه مثل المطوق من الطيور كذا في الشرح ومثل القطع طلبه بنحو مغرة أو نحته أو غسله ومحو الوجه كمحو الرأس بخلاف قطع اليدين والرجلين فإن الكراهة لا تزول بذلك لأن الإنسان قد تقطع أطرافه وهو حي كما في الفتح وأفاد بهذا التعليل أن قطع الرأس ليس بقيد بل المراد جعلها على حالة لا تعيش معها مطلقا حاشية الطحطاوي على مراقي الفلاح شرح نور الإيضاح (ص: 362) دار الكتب العلمية بيروت – لبنان
