Does the statement “nahi rehna chahti to chor do mjhe, nahi rehna chahti to chor do mjhe, talakh” constitute a divorce?

Answered as per Hanafi Fiqh by Askimam.org

My father said to my mother ” nahi rehna chahti to chor do mjhe, nahi rehna chahti to chor do mjhe, talakh”.  Does this statement constitute divorce?  If yes then what kind of divorce and what has to be done now. How do I solve the matter.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu alaykum wa-rahmatullāhi wa-barakātuh.

There are different dimensions of the statement uttered by your father. The ruling of each dimension also depends upon the intention of your father. We advise your father contacts your local Alim or Mufti to analyze the situation and issue a ruling accordingly.[1]
