Confusion about making du`a before reading sunnah.

‘Umar b. ‘Ata’ b. Abu Khuwar said that Nafi’ b. Jubair sent him to al- Sa’ib the son of Namir’s sister with a view to asking him about what he had seen in the prayer of Mu’awiya. He said:Yes, I observed the Jumu’a prayer along with him in Maqsura and when the Imam pronounced salutation I stood up at my place and observed (Sunan rak’ahs). As he entered (the apartment) he sent for me and said: Do not repeat what you have done. Whenever you have observed the Jumu’a prayer, do not observe (Sunan prayer) till you, have talked or got out For the Messenger of Allah (?) had ordered us to do this and not to combine two (types of) prayers without talking of going out.

Maulana Rasheed Ahmad Gangohi r.a has said in

Al Kaokab  Ud Durari Chapter: What Is Said When Saying The Salam [After Salat] , Vol 2 , page 318,319 , publisher maktabat usheikh , urdu translation

that some jurist are of the view thatthe time to delay sunnah after farz  ( for recitation of masnoon azkaar )is 2 rakaats prayer timeand it is not jaiz to stay beyond this 2 rakats prayer time after farz to delay sunnah.And he said that as sunnah complete fariz , similarly masnoon azkaar also complete fariz , so as long as these azkaar are recited within the 2 rakats time frame.

Shamsul aimma Halwani r.a said

لَا بَأْسَ بِالْفَصْلِ بِالْأَوْرَادِ 

My Question is 

After the completion of the Fardh prayer, how much time is not makrooh in getting up to perform his Sunnah Salaah ?

Maulana Rasheed Ahmad Gangohi r.a has said that about 2 rakats prayer time one can delay sunnah.

And whether it is makrooh e tehreemi or makrooh e tanzeehi to complete awraad before sunnah salaah ?

as Maulana Ibn e Abideen say that ويكره تأخير السنة إلا بقدر اللهم أنت السلام

And if it is makrooh e tanzihi so then why is allowed by Imam Halwani ? as  occurence of makrooh e tanzihi is also sin ( Kafayatul mufti 9/131 )

I know that jurists say that لَا بَأْسَ means dislikement but does it mean makrooh e tanzehi ?

Hazrat Ibn e Abideen says that completion of awraad makes sunnah prayer against sunnah تَّى لَوْ صَلَّاهَا بَعْدَ الْأَوْرَادِ تَقَعُ سُنَّةً مُؤَدَّاةً، لَكِنْ لَا فِي وَقْتِهَا الْمَسْنُونِ and Imama Halwani says لَا بَأْسَ بِالْفَصْلِ بِالْأَوْرَادِ ,

How would be these two statements reconciled ?

I know that jurists know ahadiths better.And Shamsul Aimma Halwani is in the top most category of jurists of Imam Kashmiri list then the other comes.And Maulana Gangohi was termed Faqih un nafas by many scholors.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We have taken note of your previous questions on issues pertaining to differences between fuqahā’. Based on the style of your query, we will assume that you have adequate knowledge of Arabic and fiqh; therefore, we will not provide translations of any of our statements and we shall stick to quoting the original Arabic only.

In order to fully comprehend the meaning of this hadīth along with the rulings pertaining to it, we shall first provide an explanation of the hadīth before providing the texts of the fuqahā’.

The hadīth you refer to has been mentioned both in Sahīh Muslim[1] and Sunan Abī Dāwūd[2]. The original Arabic of the hadīth is as follows: 

أَخْبَرَنِي عُمَرُ بْنُ عَطَاءِ بْنِ أَبِي الْخُوَارِ، أَنَّ نَافِعَ بْنَ جُبَيْرٍ، أَرْسَلَهُ إِلَى السَّائِبِ – ابْنِ أُخْتِ نَمِرٍ – يَسْأَلُهُ عَنْ شَيْءٍ رَآهُ مِنْهُ مُعَاوِيَةُ فِي الصَّلَاةِ، فَقَالَ: نَعَمْ، صَلَّيْتُ مَعَهُ الْجُمُعَةَ فِي الْمَقْصُورَةِ، فَلَمَّا سَلَّمَ الْإِمَامُ قُمْتُ فِي مَقَامِي، فَصَلَّيْتُ، فَلَمَّا دَخَلَ أَرْسَلَ إِلَيَّ، فَقَالَ: «لَا تَعُدْ لِمَا فَعَلْتَ، إِذَا صَلَّيْتَ الْجُمُعَةَ، فَلَا تَصِلْهَا بِصَلَاةٍ حَتَّى تَكَلَّمَ أَوْ تَخْرُجَ، فَإِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَمَرَنَا بِذَلِكَ، أَنْ لَا تُوصَلَ صَلَاةٌ بِصَلَاةٍ حَتَّى نَتَكَلَّمَ أَوْ نَخْرُجَ».

Regarding this hadīth, Mufti Shabbīr Uthmānī states in his Fath al-Mulhim:

قال القاري: والمقصود بهما الفصل بين الصلاتين؛ لئلا يوهم الوصل، فالأمر للاستحباب، والنهي للتنزيه. وقال النووي: فيه دليل لما قاله أصحابنا أن النافلة الراتبة وغيرها يستحب أن يتحول لها عن موضع الفريضة إلي موضع آخر…وقوله حتي نتكلم دليل أن الفصل بينهما يحصل بالكلام أيضا، ولكن بالانتقال أفضل…

From the above statements, we may highlight the following points:

1) The command in the hadīth is to create separation between one’s fard and non-fard prayers.

2) One may physically move or simply perform an action that shows that one has finished salāh (e.g. talking) in order to create this separation.

3) This command has been labeled as “recommended” or “desirable” by Imam Nawawī (rahimahullāh); therefore, it does not tantamount to a sin if one does not do so.

As far as the statements of our fuqahā’, `Allāmah al-Haskafī states in Al-Durr Al-Mukhtār:

وَيُكْرَهُ تَأْخِيرُ السُّنَّةِ إلَّا بِقَدْرِ اللَّهُمَّ أَنْتَ السَّلَامُ إلَخْ. قَالَ الْحَلْوَانِيُّ: لَا بَأْسَ بِالْفَصْلِ بِالْأَوْرَادِ وَاخْتَارَهُ الْكَمَالُ. قَالَ الْحَلَبِيُّ: إنْ أُرِيدَ بِالْكَرَاهَةِ التَّنْزِيهِيَّةُ ارْتَفَعَ الْخِلَافُ قُلْت: وَفِي حِفْظِي حَمَلَهُ عَلَى الْقَلِيلَةِ

Commenting on this, `Allāmah Ibn `Ābidīn states in his Radd al-Muhtār:

(قَوْلُهُ وَاخْتَارَهُ الْكَمَالُ) فِيهِ أَنَّ الَّذِي اخْتَارَهُ الْكَمَالُ هُوَ الْأَوَّلُ، وَهُوَ قَوْلُ الْبَقَّالِيُّ. وَرُدَّ مَا فِي شَرْحِ الشَّهِيدِ مِنْ أَنَّ الْقِيَامَ إلَى السُّنَّةِ مُتَّصِلًا بِالْفَرْضِ مَسْنُونٌ، ثُمَّ قَالَ: وَعِنْدِي أَنَّ قَوْلَ الْحَلْوَانِيِّ لَا بَأْسَ لَا يُعَارِضُ الْقَوْلَيْنِ لِأَنَّ الْمَشْهُورَ فِي هَذِهِ الْعِبَارَةِ كَوْنُ خِلَافِهِ أَوْلَى، فَكَانَ مَعْنَاهَا أَنَّ الْأَوْلَى أَنْ لَا يَقْرَأَ قَبْلَ السُّنَّةِ، وَلَوْ فَعَلَ لَا بَأْسَ، فَأَفَادَ عَدَمَ سُقُوطِ السُّنَّةِ بِذَلِكَ، حَتَّى إذَا صَلَّى بَعْد الْأَوْرَادِ تَقَعُ سُنَّةً لَا عَلَى وَجْهِ السُّنَّةِ، وَلِذَا قَالُوا: لَوْ تَكَلَّمَ بَعْدَ الْفَرْضِ لَا تَسْقُطُ لَكِنَّ ثَوَابَهَا أَقَلُّ، فَلَا أَقَلَّ مِنْ كَوْنِ قِرَاءَةِ الْأَوْرَادِ لَا تُسْقِطُهَا اهـ…(قَوْلُهُ قَالَ الْحَلَبِيُّ إلَخْ) هُوَ عَيْنُ مَا قَالَهُ الْكَمَالُ فِي كَلَامِ الْحَلْوَانِيِّ مِنْ عَدَمِ الْمُعَارَضَةِ ط (قَوْلُهُ ارْتَفَعَ الْخِلَافُ) لِأَنَّهُ إذَا كَانَتْ الزِّيَادَةُ مَكْرُوهَةً تَنْزِيهًا كَانَتْ خِلَافَ الْأَوْلَى الَّذِي هُوَ مَعْنَى لَا بَأْسَ (قَوْلُهُ وَفِي حِفْظِي إلَخْ) تَوْفِيقٌ آخَرُ بَيْنَ الْقَوْلَيْنِ، الْمَذْكُورَيْنِ، وَذَلِكَ بِأَنَّ الْمُرَادَ فِي قَوْلِ الْحَلْوَانِيِّ لَا بَأْسَ بِالْفَصْلِ بِالْأَوْرَادِ: أَيْ الْقَلِيلَةِ الَّتِي بِمِقْدَارِ ” اللَّهُمَّ أَنْتَ السَّلَامُ إلَخْ ” لِمَا عَلِمْت مِنْ أَنَّهُ لَيْسَ الْمُرَادُ خُصُوصَ ذَلِكَ، بَلْ هُوَ أَوْ مَا قَارَبَهُ فِي الْمِقْدَارِ بِلَا زِيَادَةٍ كَثِيرَةٍ فَتَأَمَّلْ. وَعَلَيْهِ فَالْكَرَاهَةُ عَلَى الزِّيَادَةِ تَنْزِيهِيَّةٌ لِمَا عَلِمْت مِنْ عَدَمِ دَلِيلِ التَّحْرِيمِيَّةِ

In relation to this difference between the statements of the fuqahā’, `Allāmah Rāfi`ī states in his Taqrīrāt on Radd al-Muhtār:

(ارتفع الخلاف) أي: بين البقالي والحلواني، و أما الخلاف بين الشهيد والبقالي فثابت لم يرتفع لأن الشهيد يكره الفصل حتي بقول اللهم أنت السلام الخ. و البقالي لم يكره بذلك القدر لا كراهة تحريمية و لا تنزيهية…قوله: (بأن المراد بقول الحلواني لا بأس إلخ) أي: مع حمل قوله لا بأس علي الإباحة. والله اعلم.[3]

Imam Shurunbulālī states in his Marāqī al-Falāh:

“متصلا بالفرض مسنون” أي أنه يستحب الفصل بينهما كما كان عليه السلام إذا سلم يمكث قدر ما يقول: اللهم أنت السلام…ثم يقوم إلى السنة قال الكمال وهذا هو الذي ثبت عنه صلى الله عليه وسلم من الأذكار التي تؤخر عنه السنة ويفصل بينها وبين الفرض انتهى.. “و” قال الكمال “عن شمس الأئمة الحلواني” أنه قال “لا بأس بقراءة الأوراد بين الفريضة والسنة” فالأولى تأخير الأوراد عن السنة فهذا ينفي الكراهة ويخالفه ما قاله في الاختيار كل صلاة بعدها سنة يكره القعود بعدها والدعاء بل يشتغل بالسنة كيلا يفصل بين السنة

Commenting on the statement of Shurunbulālī, Imam Tahtāwī states in his Hashiyah:

“ويخالفه الخ” تنتفي المخالفة بحمل الكراهة المذكورة في الاختيار على التنزيهية وهي معنى قول الحلواني لا بأس لأنها تستعمل فيما خلافه أولى منه أو يحمل ما في الاختيار على كراهة التحريم ويحمل على الأدعية الطويلة وحينئذ يكون ما قاله الحلواني محمولا على الفصل بنحو اللهم أنت السلام ولا بأس مستعملة في مطلق الجواز[4]

Imam Burhān al-Dīn states in his Al-Muhīt al-Burhānī:

و إذا قام إلي التطوع، لا يتطوع في مكانه الذي صلي المكتوبة فيه، بل يتقدم أو يتأخر، أو ينحرف يمينا أو شمالا، أو يذهب الي بيته يتطوع فيه…قال الشيخ الإمام شمس الأئمة الحلواني رحمه الله: و هذا إذا لم يكن من قصده الإشتغال بالدعاء، فإن كان له ورد يقضيه بعد المكتوبات، فأراد أن يقضي قبل أن يشتغل بالتطوع، فإنه يقوم عن مصلاه فيقضي ورده قائما، وإن شاء جلس في ناحية من المسجد و قضي ورده، ثم قام الي التطوع…والأمر فيه واسع، و ماذكره شمس الأئمة الحلواني رحمه الله دليل علي جواز تأخير السنن عن حال أداء المكتوبة، و ما ذكرنا في ابتداء المسألة نص علي كراهية تأخير السنن عن حال أداء الفريضة، هذا الذي ذكرنا في حق الإمام. وأما المنفرد والمقتدي فإن شاءا قاما في مصلاهما، وإن شاء قاما للتطوع في مكانهما، أو في مكان آخر.[5]

Based on the abovementioned statements, we arrive at the following conclusions:

1) There are two opinions mentioned regarding adhkār after salāh before performing one’s sunnahs.

2) Imam Halwānī has made the statement that it is fine to delay one’s sunnah without providing any extra details regarding his statement.

3) In reconciliation of the two opinions, specifically regarding the statement of Imam Halwānī, the fuqahā’ have provided two explanations:

a)     Imam Halwānī’s statement means that it is mubāh (permissible) to delay one’s sunnahs by reciting a few short adhkār; however, if one recites long adhkār then it is makrūh tahrīmī.

b)    Makrūh here refers to makrūh tanzīhī in the meaning of khilāf al-awlā. In other words, it simply means that it is “better” to not delay one’s sunnah, but it is still permissible as stated by Imam Halwānī.

4) Due to the difference of opinion on this matter, Imam Burhān al-Dīn simply states that there is room to accommodate both opinions as the statements of the fuqahā’ vary on this issue. Furthermore, Imam Burhān al-Dīn states that this difference is only in reference to the Imam who is leading the prayer and not necessarily the muqtadīs that are praying behind him.

To conclude, we shall quote the statement of Faqīh al-Ummat, Mufti Mahmūd Gangohī regarding this specific query as stated in his Fatāwā Mahmūdiyyah:

It is surely better to pray one’s sunnahs right after the fard prayer; however, if the imam of the prayer chooses otherwise, then there is no need to be persistent on such a thing as there is no sin in reading one’s adhkār[6] before praying the sunnahs.[7]
