Using Masjid funds for purchasing grave plots

I want to know whether mosque funds received in donations can be invested in purchasing grave plots. The purpose is to buy the plots now as an investment and sell it to neeedy at a higher profit.

Plots prices keeps on oncreasing every single year and idea is to buy these plots now and sell it on nominal profit so masjid gets income. In future if grave price go up masjid will also increase the price and sell it on market value.

Kindly reply as soon as possible as this matter is discussed in our community whether it’s allowed or no do such investments for masjid.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is important to take cognisance of the conditions and intentions of those who contribute funds to the Masjid. If certain contributions are made for a specific purpose, it is the responsibility of those in charge of the affairs of the Masjid to honour the conditions of the contributor.[1] If nothing has been specified, and there is no mutual understanding, the funds may be utilised for anything that is of benefit to the Masjid and its Musallees.[2]

In principle, it is permissible to purchase the grave plots as an investment if there is hope of the venture being profitable.[3] However, if those people who had contributed the money are unhappy with this, it is not advisable to do so. Purchasing the plots in such a situation may have a negative effect on the future contributions from such people.

The ideal would be to collect funds for the purpose of purchasing the grave plots. In this manner, there will be no misgivings from the contributors.

مطلب مراعاة غرض الواقفين واجبة والعرف يصلح مخصصا

وهكذا رأيته في نسخة أخرى بلفظ الأول أقرب إلى الصواب، فهدا نص صريح في التفرقة بين الهبة والوقف فتكون الفريضة الشرعية في الوقف هي المفاضلة فإذا أطلقها الواقف انصرفت إليها لأنها هي الكاملة المعهودة في باب الوقف، وإن كان الكامل عكسها في باب الصدقة فالتسوية بينهما غير صحيحة، على أنهم صرحوا بأن مراعاة غرض الواقفين واجبة، وصرح الأصوليون بأن العرف يصلح مخصصا والعرف العام بين الخواص والعوام أن الفريضة الشرعية يراد بها المفاضلة: وهي إعطاء الذكر مثل حظ الأنثيين، ولذا يقع التصريح بذلك لزيادة التأكيد في غالب كتب الأوقاف، بأن يقول: يقسم بينهم على الفريضة الشرعية للذكر مثل حظ الأنثيين ولا تكاد تسمع أحدا يقول على الفريضة الشرعية: للذكر مثل حظ الأنثى لأنه غير المتعارف بينهم في هذا اللفظ،

وفي الأشباه في قاعدة العادة محكمة، أن ألفاظ الواقفين تبنى على عرفهم كما في وقف فتح القدير، ومثله في فتاوى ابن حجر، ونقل التصريح بذلك عن جماعة من أهل مذهبه وفي جامع الفصولين مطلق الكلام فيما بين الناس ينصرف إلى المتعارف، وقدمنا نحوه عن العلامة قاسم وقد مر وجوب العمل بشرط الواقف، فحيث شرط القسمة كذلك وكان عرفه بهذا اللفظ المفاضلة وجب العمل بما أراده، ولا يجوز صرف اللفظ عن مدلوله العرفي لأنه صار حقيقة عرفية في هذا المعنى والألفاظ تحمل على معانيها الحقيقية اللغوية إن لم يعارضها نقل في العرف إلى معنى آخر، فلفظ الفريضة الشرعية إذا كان معناه لغة أو شرعا التسوية وكان معناه في العرف المفاضلة، وجب حمله على المعنى العرفي كما علمت، ولو ثبت أن المفاضلة في الوقف مكروهة كما في الهبة وأن النص الوارد في الهبة وارد في الوقف أيضا نقول إن هذا الواقف أراد المفاضلة، وارتكب المكروه، فلا يكون في ذلك تقديم العرف على النص بل فيه إعمال النص بإثبات الكرامة فيما فعله، وإعمال لفظه بحمله على مدلوله العرفي، فإن النص لا يغير الألفاظ عن معانيها المرادة، بل يبقى اللفظ على مدلوله العرفي، وهو المفاضلة لأنه صار علما عليها، وهي فريضة شرعية في ميراث الأولاد، فإذا ذكرها في وقفه على أولاده وجب العمل بمراده، وهذا كله بعد تسليم أن المفاضلة في الوقف مكروهة كما في الهبة، وقد سمعت التصريح بخلاف عن الظهيرية.
