Inhaling Oxygen Whilst Fasting

A brother has to inhale oxygen whenever he sleeps. The oxygen has to be inhaled by him as long as he is sleeping. He cannot sleep without oxygen. This procedure is permanent. Now does this oxygen inhaling breaks his fast or not? As you know oxygen is only air. He says there is no medication mixed in it. Please reply asap.

[1]In the above referred, we have consulted a doctor. We are advised that the oxygen contains only air and does not contain any form of medication. As such, the oxygen inhaled does not nullify ones fast.[2]

Oxygen machines provide high levels of oxygen to people with respiratory conditions. Some machines contain compressed forms of oxygen and convert them into breathable oxygen when in use. These machines suit people who need oxygen only for short periods. People who need constant oxygen supply would benefit more from machines that extract oxygen from the air.

[2] 1} (قَالَ) : وَإِنْ دَخَلَ ذُبَابٌ جَوْفَهُ لَمْ يُفْطِرْهُ وَلَمْ يَضُرَّهُ، وَهَذَا اسْتِحْسَانٌ وَكَانَ يَنْبَغِي فِي الْقِيَاسِ أَنْ يَفْسُدَ صَوْمُهُ؛ لِأَنَّهُ لَيْسَ فِيهِ أَكْثَرُ مِنْ أَنَّهُ غَيْرُ مُغَذٍّ وَأَنَّهُ لَا صُنْعَ لَهُ فِيهِ فَكَانَ نَظِيرُ التُّرَابِ يُهَالُ فِي حَلْقِهِ وَفِي الِاسْتِحْسَانِ لَا يَضُرُّهُ هَذَا؛ لِأَنَّهُ لَا يُسْتَطَاعُ الِامْتِنَاعُ مِنْهُ فَإِنَّ الصَّائِمَ لَا يَجِدُ بُدًّا مِنْ أَنْ يُفْتَحَ فَمَهُ فَيَتَحَدَّثَ مَعَ النَّاسِ وَمَا لَا يُمْكِنُ التَّحَرُّزُ عَنْهُ فَهُوَ عَفْوٌ؛ وَلِأَنَّهُ مِمَّا لَا يَتَغَذَّى بِهِ فَلَا يَنْعَدِمُ بِهِ مَعْنَى الْإِمْسَاكِ، وَهُوَ نَظِيرُ الدُّخَانِ وَالْغُبَارِ يَدْخُلُ حَلْقَهُ قَالَ أَبُو يُوسُفَ: – رَحِمَهُ اللَّهُ تَعَالَى – وَقَدْ يَدْخُلُ فِي هَذَا الِاسْتِحْسَانِ بِصِفَةِ الْقِيَاسِ فَإِنَّهُ لَوْ كَانَ الذُّبَابُ فِي حَلْقِهِ ثُمَّ طَارَ لَمْ يَضُرَّهُ، وَلَوْ كَانَ هَذَا مُفْسِدًا لِلصَّوْمِ لَكَانَ بِوُصُولِهِ إلَى بَاطِنِهِ يُفْسِدُ صَوْمَهُ، وَإِنْ خَرَجَ بَعْدَ ذَلِكَ، وَإِنْ نَزَلَ فِي حَلْقِهِ ثَلْجٌ أَوْ مَطَرٌ فَقَدْ اخْتَلَفَ مَشَايِخُنَا فِيهِ وَالصَّحِيحُ أَنَّهُ يُفْطِرُهُ؛ لِأَنَّ هَذَا مِمَّا يُسْتَطَاعُ الِامْتِنَاعُ مِنْهُ بِأَنْ يَكُونَ تَحْتَ السَّقْفِ؛ وَلِأَنَّ هَذَا مِمَّا يُتَغَذَّى بِهِ { المبسوط، ج 3، ص 93، دار المعرفة – بيروت }

ولو دخلَ حلقَه ذبابٌ أو غبارٌ أو دخانٌ وهو ذاكرٌ لصومه لم يفطر(3) :

} (3) لأنه ليس بطعام؛ ولأنه مغلوب فلا يستطيع الامتناع عنه؛ لأن الصائم لا يجد بداً من أن2

(أَوْ دَخَلَ حَلْقَهُ غُبَارٌ أَوْ ذُبَابٌ أَوْ دُخَانٌ) وَلَوْ ذَاكِرًا اسْتِحْسَانًا لِعَدَمِ إمْكَانِ التَّحَرُّزِ عَنْهُ،   }3

حاشية ابن عابدين :

(قَوْلُهُ: اسْتِحْسَانًا) وَفِي الْقِيَاسِ يَفْسُدُ أَيْ بِدُخُولِ الذُّبَابِ لِوُصُولِ الْمُفْطِرِ إلَى جَوْفِهِ وَإِنْ كَانَ لَا يَتَغَذَّى بِهِ كَالتُّرَابِ وَالْحَصَادِ هِدَايَةٌ (قَوْلُهُ: لِعَدَمِ إمْكَانِ التَّحَرُّزِ عَنْهُ) فَأَشْبَهَ الْغُبَارَ وَالدُّخَانَ لِدُخُولِهِمَا مِنْ الْأَنْفِ إذَا أَطْبَقَ الْفَمَ كَمَا فِي الْفَتْحِ، { رد المحتار على الدر المختار، ج 2، ص 395، دار الفكر-بيروت }
