Is a secret marriage valid without the girl having the wali’s approval?

Answered as per Hanafi Fiqh by Askimam.org

1)Is it nessesary to floss and brush your teeth before ghusl because of food particles that are stuck in teeth because its hard and time consuming to to do so?

2) is a secret marriage valid without the girl having the wali’s approval when i am pretty much equal or better than her in religion, lineage, and education but the only thing is that i do not have a job at the moment but she would be staying at her parents house?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1)     It is not necessary to floss and brush ones teeth before ghusal.[1]

2)     There are two aspects to consider regarding a secret nikah. One is the validity of the nikah and the other is the practicality and effects of the secret nikah.  If a proposal and acceptance takes place in the presence of two adult male witnesses or one male and two female witnesses, the nikah between the boy and girl is valid. The couple will be legally married and any subsequent contact will be permissible. [2]

According to the Hanafi school of thought, an adult girl does not require the approval of her wali to get married. [3] However, it is inappropriate for a girl to marry secretly. Consider the following hadith:

عَنْ عَبْدِ اللهِ بْنِ الزُّبَيْرِ، أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: ” أَعْلِنُوا النِّكَاحَ  [4]

Translation: Abdullah bin Zubayr radhiallahu anhu narrates that Rasulullah sallallahu alaihi wasallam said: “Publicize the nikāh”

Furthermore, if you are better in status than the girl, then why should the nikah be a secret? You should also understand that there are many negative consequences of secret nikah that one realises only after such a nikah. This may negatively impact on the actual purpose of the nikah being peace and tranquility.
