Can I sidestep Hajj regulations?

I am pakistani national living in UK from past 3 years as student with my two kids. My husband is living in Kuwait and he and our chikdren were born in Kuwait. Now as you know that Gulf rules are getting tougher and strange, Saudia has imposed a new rule that all the foreigners have to go back to their home country to do Hajj.

It would be very difficult for me to bring back my children from UK to Kuwait and leave with our relatives, then me and my husband go Pakistan and from there get visas for Hajj and then go Saudia and then again from Pak to kuwait to finally UK. i wanted to ask that we know a man in Kuwait who can take us from Kuwait to Saudia for Hajj, he would show me and my husband as workers to help the group of Hajjis he would be taking to Saudia. Would that be allowed or is unlawful and our hajj would not be accepted?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa rahmatullāhi wa barakātuh.

It may be advisable to enlist yourself and your husband as workers from Kuwait with an intention to assist in the work in reference, even if in a limited capacity. In this way, you will not be violating the Hajj regulations, nor will your claim as workers be untrue. However, if one were to come in the pretext of a worker only to evade Hajj regulations, although incorrect[1], the Hajj will not be affected.[2]

الْحَجِّ فَشَيْئَانِ: أَحَدُهُمَا.الْوُقُوفُ بِعَرَفَةَ وَهُوَ الرُّكْنُ الْأَصْلِيُّ لِلْحَجِّ، وَالثَّانِي طَوَافُ الزِّيَارَةِ. (بدائع الصنائع في ترتيب الشرائع، ج ٣، ص ٥٨، دار الكتب العلمية)؛

(وَ) الْحَجُّ (فَرْضُهُ) ثَلَاثَةٌ (الْإِحْرَامُ) وَهُوَ شَرْطُ ابْتِدَاءٍ، وَلَهُ حُكْمُ الرُّكْنِ انْتِهَاءً حَتَّى لَمْ يَجُزْ لِفَائِتِ الْحَجِّ اسْتِدَامَتُهُ لِيَقْضِيَ بِهِ مِنْ قَابِلٍ (وَالْوُقُوفُ بِعَرَفَةَ) فِي أَوَانِهِ سُمِّيَتْ بِهِ لِأَنَّ آدَمَ وَحَوَّاءَ تَعَارَفَا فِيهَا (وَ) مُعْظَمُ (طَوَافِ الزِّيَارَةِ) وَهُمَا رُكْنَانِ (الدر المختار مع رد المحتار، ج ٣، ص ٥٣٦-٥٣٧، دار المعرفة)؛

إنَّهُ فُرِضَ عَلَى كُلِّ حُرٍّ بَالِغٍ عَاقِلٍ صَحِيحٍ إذَا قَدَرَ عَلَى الزَّادِ وَالرَّاحِلَةِ فَاضِلًا عَنْ الْمَسْكَنِ وَمَا لَا بُدَّ مِنْهُ، وَعَنْ نَفَقَةِ عِيَالِهِ إلَى حِينِ عَوْدِهِ وَكَانَ الطَّرِيقُ آمِنًا (العناية شرح الهداية، ج ٢، ص ٥، دار الكتب العلمية)؛

مَنْ لَمْ يَجِبْ عَلَيْهِ الْحَجُّ بِنَفْسِهِ لِعُذْرٍ كَالْمَرِيضِ، وَنَحْوِهِ، وَلَهُ مَالٌ يَلْزَمُهُ أَنْ يُحِجَّ رَجُلًا عَنْهُ، وَيُجْزِئُهُ عَنْ حَجَّةِ الْإِسْلَامِ إذَا وَجَدَ شَرَائِطَ جَوَازِ الْإِحْجَاجِ عَلَى مَا نَذْكُرُهُ، وَلَوْ تَكَلَّفَ وَاحِدٌ مِمَّنْ لَهُ عُذْرٌ فَحَجَّ بِنَفْسِهِ أَجْزَأَهُ عَنْ حَجَّةِ الْإِسْلَامِ إذَا كَانَ عَاقِلًا بَالِغًا حُرًّا؛ لِأَنَّهُ مِنْ أَهْلِ الْفَرْضِ إلَّا أَنَّهُ لَمْ يَجِبْ عَلَيْهِ؛ لِأَنَّهُ لَا يُمْكِنُهُ الْوُصُولُ إلَى مَكَّةَ إلَّا بِحَرَجٍ، فَإِذَا تَحَمَّلَ الْحَرَجَ، وَقَعَ مَوْقِعَهُ كَالْفَقِيرِ إذَا حَجَّ، وَالْعَبْدِ إذَا حَضَرَ الْجُمُعَةَ فَأَدَّاهَا؛ وَلِأَنَّهُ إذَا وَصَلَ إلَى مَكَّةَ صَارَ كَأَهْلِ مَكَّةَ فَيَلْزَمُهُ الْحَجُّ بِخِلَافِ الْعَبْدِ، وَالصَّبِيِّ، وَالْمَجْنُونِ فَإِنَّ الْعَبْدَ، وَالصَّبِيَّ لَيْسَا مِنْ أَهْلِ فَرْضِ الْحَجِّ، وَالْمَجْنُونُ لَيْسَ مِنْ أَهْلِ الْعِبَادَةِ أَصْلًا، وَاَللَّهُ أَعْلَمُ (بدائع الصنائع في ترتيب الشرائع، ج ٣، ص ٥٧، دار الكتب العلمية)
