can Muslim women allow to marry with non-muslim or the person exact shahada over the phone and clam he is converted muslim please give me a datail with qur`an& sunnah
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
1) The purpose of Nikah is to safeguard one’s chastity and attain peace and comfort through it. While performing the Nikah is a noble act, one has to be conscious of many issues related to it.
The parameters of Shari’āh are quite different to those of other religions. Islām strives to maintain and promote a high level of compliancy to its regulations, hence, blocking out any such avenues that may lead to harming ones Īmān (faith) or even causing it to wane. As such, Islām advocates that one socialises and interacts with those who are Muslims themselves.
One’s family and friends tend to greatly influence his/her habits, thinking, traits and actions. Therefore, Islām advocates that the institution of marriage be conducted with such a spouse who is chaste and noble, so that he/she may compliment the other in his/her religious activities.
Hence, Shari’ah only permits a woman to get married to a Muslim man.[1] Allah Subhanahu Wa Ta`ala clearly states in the Qur`an:
وَلَا تَنْكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ وَلَأَمَةٌ مُؤْمِنَةٌ خَيْرٌ مِنْ مُشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلَا تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُؤْمِنٌ خَيْرٌ مِنْ مُشْرِكٍ وَلَوْ أَعْجَبَكُمْ

“And do not marry Al-Mushrikat (idolatresses, etc.) till they believe (worship Allah Alone). And indeed a slave woman who believes is better than a (free) Mushrikah (idolatress, etc.), even though she pleases you. And give not (your daughters) in marriage to Al-Mushrikun till they believe (in Allah Alone) and verily, a believing slave is better than a (free) Mushrik (idolater, etc.), even though he pleases you.”[2] |
This clearly states the prohibition of any Muslim marrying a Non-Muslim. However, Allah Subhanahu Wa Ta`ala permitted Muslim men to marry Christian or Jewish women[3] by the following Ayah:
وَالْمُحْصَنَاتُ مِنَ الْمُؤْمِنَاتِ وَالْمُحْصَنَاتُ مِنَ الَّذِينَ أُوتُوا الْكِتَابَ مِنْ قَبْلِكُمْ إِذَا آتَيْتُمُوهُنَّ أُجُورَهُنَّ مُحْصِنِينَ غَيْرَ مُسَافِحِينَ وَلَا مُتَّخِذِي أَخْدَانٍ
(Lawful to you in marriage is) And good women from among believers, and good women from among those who were given the Book before you (Jews and Christians), provided you give them their dowers, binding yourself in marriage, neither going for lust, nor having paramours.[4]
Hence, the prohibition of Muslim women marrying Non-Muslims still remains.
2) The second part of your query is unclear. What do you mean by “exact shahāda”; to become a Muslim or to perform Nikah?
